FIRE!!!!!!!!!!!!!!! ......questions

My marineland heater just caught on fire in the middle of the night. Thank god for fire alarms. My office was filled with smoke and the heater itself was on fire.

questions:
has this happened to anyone else?
do I need to do water changes on my other tanks in the room?

Damage so far:
sump
return pump
skimmer pump
heater

pics to follow tomorrow
 
Sorry to hear about that, but it does bring up a good point. We should all have smoke detectors very close if not right above out tanks. The fact is we are pumping a lot of electricity into those boxes, and then we are exposing all that electric equipment to the most corosive stuff in our homes. Looking around, I do not have a smoke dector for about 30 feet, close, maybe, bu not close enough.
 
Is there any recourse on the manufacture if you can prove it started the fire?

A UPS back up caught on fire at a company we consult and there was a law suit against them. The fire dept. acknowledged thats where the fire originated from.
 
Thank god I am a lawyer :), I will be sending a demand letter for damages to both Petco and Marineland. By looking at the heater, it is obvious that it was the heater.

Can you prove it wasn't user errer, ie. used as per manufacturers directions (correct water level)?
 
better get a report from a fire chief or something or the other... they will ask for an expert final decision... but you already know that :D
 
i believe that the only recoarse that you have are just for the replacement of the heater. "not liable for consiquencial damages"...bla. bla bla. unless you can prove a pattern failure. try bureau of consumer affairs.

Yea, good luck proving it, of course, you already know the extent of the burden of proof for civil cases.

More importantly, congratulations for being yet another overly litigious lawyer in America. Nothing makes this country great like suing over everything. Petco? Petco didn't make the heater or force you to buy it? How did they cause any damage to you?
 
I am sorry for the fire which could have been worse. I am more disappointed this thread is going this route.... :rolleye1:

I guess this is where the "ambulance chaser/ankle biter" phrase came from.

I posted a thread asking technical and experiential questions regarding a horribly frightening experience that my family went through at 3:30 am this morning, which I believe is important to share with fellow reefers. We woke up to the sound of a blaring fire alarm only to discover my entire office was filled with smoke, toxic fumes and a bright red glare coming from my sump, which was consumed with fire. We spent the early morning with the fire department, which after inspecting my entire tank, suggested that we seek recourse since the heater was clearly defective. How dare anyone question my integrity when I respond to an inquiry regarding recourse against the manufacturer and my intention to send a demand letter to both the manufacturer and retailer (two responsible parties under established products liability law). Now...if anyone has something to add that is responsive to the post, I would welcome the information. Otherwise, I am not interested in cynical, nasty, uninformed "Judge Judy" efforts at lawyering.
 
Well, don't buy marineland heaters from Petco and don't take legal advice from the fire department. Did someone watch "legally blond" tonight?
