I would suggest that you rethink your choice of words before you make comments like:

please no faulty legal advice from nonlawyers.

These people are just stating their opinions in order to try and help you out. Those kind of words are just asking for a flame and a very non friendly response from others.

I don't believe anyone was questioning your integrity ~ people are just trying to think of things that ANYONE while upset may not think of.

My statement wasn't that there existed no precedent (I'm sure there probably does), or that you wouldn't be successful in a suit (you very well may), it's that you're overly litigious, suing someone who did nothing more than selling a product you chose to buy.

So you want to complain to the manufacturer, good luck. But petco? Petco?! Why don't you go run along PCH, wait to get hit by a passing motorist (1 in a million chance, just like your heater blowing up), then sue both Nike for making shoes and Footlocker for selling you shoes that let you get hit by a car?

How dare I? How dare you sue a company just for selling a product that they didn't make, didn't endorse, and didn't force you to buy? You're a perfect example of everthing that's wrong with this country. It's all about you, you, you, and not about what's right or just.
 
I've had just about every single heater I've owned explode, catch on fire, fill with water, stick on/off, or shock me.

I wouldn't dream of suing over any of them because an aquarium heater is by nature, a stupid (but necessary) device that is prone to failure.

Personally, I just try to buy the absolute best heater available, and replace it every year or so when it shows any signs of moisture or weathering.

Putting anything sold by Petco in a reef tank is just asking for trouble.

First of all, I should know better than to engage in a legal debate with a computer programmer, who clearly knows nothing about American jurisprudence or public policy and has demonstrably limited social interactions. Your idea of what's "right or just" has absolutely no rational relationship with the rights that all Americans (including you perhaps) to recover from manufacturers, distributors and retailers of defective products so the consumer (often an individual without vast legal resources) can obtain recovery without having to engage in lengthy procedural litigation over which defendant is responsible. Once the consumer obtains recovery, the trier of fact will adjudicate responsibility between/among the defendants. You have a fundamental lack of understanding about our justice system (and the English language as evidenced by your nonsensical attempt to analogize), and it is unfortunate that your lack of knowledge has reduced itself to a stereotypical "everything is wrong with this country" cynicism. I am certain that if your defective vehicle caught on fire and your family killed, you would want to obtain speedy justice and would not want to litigate the issue of whether the case was properly against BMW North America, BMW Mission Viejo, or BMW AG for 7-10 years before obtaining a resolution, while dealing with the emotional trauma of losing your family. My suggestion: spend $30 on a subscription to the NYT. Education is often the antidote to such antisocial behavior.

Listen, if you didn't want any opinions on the subject of taking actions to your situation, you shouldn't have mentioned it in the first place. No matter how hard you defend yourself on this thread, you're still making yourself look like a dolt. All this got started when you made that belittling comment on the first page and still no apology. I doubt a lot of these people will even think about helping you out here if you needed some sort of aquaria advice especially after your second belittling comment on this page. A lot of these people in the SoCal forum ARE in the IT industry and help with good aquaria info which you have most likely used.

echoplex and jjirsa aren't computer programmers either. I used to be a programmer, so I must have limited social interactions.

Yes it wasn't right for some people to make those lawyer comments, but that shows how ****ed off some of these people are at you.

This is the most unintelligent thing said in this thread. If a company makes a product, that product should be safe to use. I don't know about you, but if my heater catches on fire in the middle of the night and my house burns down and i have children in the house, this is a BIG deal.

why am I being rude? my house almost burns down early in the morning and people are being extremely rude to me. Don't expect civility from me if you are not being civil.
 
I don't think Salty is being rude.I'm surprised more of you don't have more empathy.A fire in the house while you're sleeping sounds VERY scary.
I'd be ****ed at whatever started it and whoever made it too.And if I was out any money,I'd expect them to fork out as well.As a consumer I don't expect to buy things that will threaten the safety of my family or home.

salty, just ignore those who are being rude, be a better person than them.

that must've been a real scary thing, my tank started a fire once and i was freaked out as hell, luckily i was home and nothing got damaged.

as for the tank, i would do a water change just in case. hope everything works out well and i hope they reimburse you for the damages that was caused.
