Interesting Solaris Info

I certainly understand your feelings - and happen to agree with them...
However - the type of patent is part of the issue. And it was issued within the legal bounds of the patent laws of the U.S.
The up-coming court case will reveal how valid the patent is - or is not.
Whatever the outcome, I believe we will have options in the marketplace.

I don't see Jade popping back in to tell us how he talks to them every day. He's not from World Wide in Orlando, is he? Cuz I thought they switched out all their LED fixtures for MH for due to the same problem everyone else is experiencing.

IMO, if you spend that much money on a light fixture, you should get excellent customer service, not the cold shoulder.

I smile every time i see my tank which is every day. You my friend are the perfect example of what i call a 'hater.' I have personal experience with this unit and i say that i am happy and see growth in my tank and all you do is post a useless comment to denounce someone/something. Its people like you that are truly usless to the community.
Do you have a solaris i-5? I know their previous models were bad but the new American made are much better from my experience. Also my previous tank was lit by MH

buck50bmg: I know it was meant as humor - I laughed anyway - just try not to respond harshly to him.

itsdarrow: because someone says something negative about a product you own - don't take it too personal. It is pretty harsh to say "Its people like you that are truly usless to the community" just for a comment that was perhaps meant as humor.

I am sure that are folks that own Solaris units that are happy with them. Just as I am sure there are folks that own a Solaris - and hate them because of problems with these, and now - PFO may not be around.
Many of us do not own Solaris. But we should all feel entitled to opinion when a manufacturer makes a product that does not live up to resonable standards of reliability.
I have had several friends buy the I-5..... and ALL of them were glitchy. And by glitchy I meant they wound up sending them back for a refund after going round and round with PFO with parts replacements, and even whole unit replacements.

How would you feel had you not been lucky enough to get a good unit?

The abstract for patent #7,473,008 (“Marine LED lighting system and method”) states: “A method and apparatus of lighting a marine habitat for growth utilizing an LED light system. The light system includes an LED light source, a power supply for such light source and a controller for controlling the activation status and the intensity of the LED light source.”

In describing prior art, patent #7,473,008 states: “There are many lighting systems currently available that either promote growth for land-based plants or are used for decoration or illumination of marine life. However, none of the prior art describes a system for promotion of marine life using light-emitting diode based lighting.”

Without commenting on the merits of patent #7,473,008, how does Aquaillumination avoid infringing this patent?
 
pjf, abstracts in patents don't really mean a whole lot. They are there more or less as an introduction so that people have some sort of understanding as to what is being patented. The claims section is the meat of the patent. Any issue of infringement is addressed by the language in the claims section. It is possible that Aquaillumination does not infringe on this patent. The big difference between the AI units and the Solaris is in the way they are mounted on the aquarium. AI units use a rail system, from where the lighting modules are hung. There's a question as to whether a hanging fixture could fall into the "white space" of this patent. In other words, making a hanging LED fixture could potentially get around this patent. It is pretty clear in the claims that they are describing a fixture that rests on the top edge of a tank.

"a housing connectable to said top edge to substantially cover said open top, said housing further including an inner side facing said open top when said housing is connected to said top edge and an opposite outer side;"

What is in question is whether one could consider the railing system as part of the housing for this fixture. That is up to some debate. I'm certainly not 100% confident that the AI units fall outside of this patent. I just think that there is a possibility.

Chris, I'd hate to buy Aquaillumination and then find out that you are next in Orbitec's sights. Why is it safe to buy Aquaillumination?

The AquaIllumination product, unlike the PFO Solaris, has proven to require very little warranty support in the two years of user operation.

The AquaIllumination product line is continually being developed, with new products to be released in the months to come.

Bottom line: The AquaIllumination product, its distributor, and dealers continue to sell and support the product.

Who knows what Orbitec will do. Any guarantees? Would really like to see those people at Orbitec get put in their place. Corporate greed and poor lawmakers override our quest for progress. Keep waking up to the realization that more and more of our freedoms are being robbed by our lawmakers, often fueled by corporations. The idea that PFO cannot make their unique-enough (IMO) product is a sad sign of the times.

On another note, PFO has handled this situation very poorly, no communication with their customers and basically left everyone hanging. I could have saved another $160 if someone would have just answered a phone or email and tell me not to send back to PFO the dysfunctional Solaris I had already received a return merchandise authorization for. None of these companies have made a friend out of me.
 
Most people aren't aware of how bad the problem is. Large corporations pay patent lawyers huge sums of money to make patents designed to sabotage their competition. They aren't in the game only to protect their own ideas and inventions, they're there to sink anyone who might threaten their profit margins. Anyone notice how confusing and obscure the language is in a patent? This patent isn't anywhere near as bad as some of the ones I've seen. Patent lawyers are trained in the art of writing patents that are so difficult to read and comprehend that the average person has very little chance of even getting the basic concepts. On top of that, has anyone here ever tried a patent search before? It is a huge undertaking. Many patents are worded and designed to be very difficult to find in a search. That way, the patent owner can wait until someone who has a similar idea goes through the whole process of making it realized before going at them with a patent suit. By the end of the process, the person who spent all this time and energy into building this invention of theirs ends up broke from legal fees with nothing to show for it all. The romanticized ideal of the guy who gets rich inventing something in his basement is a total myth anymore in this country.

What can be said except that lawyers are one the biggest drags on this country. They get paid ridiculous salaries to complicate bureaucracy and make the system work slower. Meanwhile, some of the most important and beneficial members of society, such as teachers, are well underpaid. The system is backwards to say the least.

I don't think I'd make a good politician. I'm way too honest. I can't fake a smile very well. Also, I'm a biomedical engineer. I don't think I've heard of too many of us going into public office, probably for good reason.

Bah, the old blame the lawyers deal again. It aggravates me when people refer to such a huge practice so broadly. Lawyers aren't the problem, the laws are. Seems like everyone wants their lawyer to do what is "right" until it comes time to representing them, and then they want the lawyer to win because "they" think they are right and are paying them to win.

I think some of the gripes about the patent laws are perfectly legitimate, but on the other hand the lowly inventer in his basement needs much more time to bring his product to fruition than a large company, and thus needs the protection the patent offers as much as anyone.

I also think there is a huge misconception in the public that "teams" of lawyers are always so much more effective than one good lawyer. The law is the law, and in the end the judge hears two sides of the story. I take down entire county attorney's offices, insurance firms, and corporations every week, and I'm just a schmuck lawyer in rural Minnesota. Believe me, PFO can hire a lawyer and defend this as well as anybody.
 
O.K. - I incited a "keyboard riot". Forgive me guys - I was only joking about lawyers. I have one on staff. ( And - he provides me with the best lawyer jokes!)
tufacody - you are are at least partially right, and - may I beg to differ with you politely - partially wrong:

You may not be aware that in excess of 70% ( last I looked - a few terms ago) of our congressmen are attorneys first. Secondly, a similar proportion of congress are millionaires prior to being elected to office.

So - if we are to be a government "of the people, by the people and for the people, one would think that we would be represented by by a group of individuals with a demographic more like what the citizenry of the the U.S.A. represents.....
Seems like it follows then - that if we are represented by a group whose majority we have little in common, in a government which is not a true democracy, rather a federal republic and - our president is not chosen by us, rather by an electoral college of hand picked persons....well-
Laws are made by lawyers.... right? So have we not created a government which is run by lawyers, that create laws in order to protect.... the law and it's lawyers?

I don't know, I am just asking...<G>

Funny, it is "personal responsibility" that makes me and many others despise lawyers.

We would be in a much better situation if it wasnt for frivilous lawsuits and a LACK of personal responsibility - many of these cases AIDED by lawyers - clogging up our legal system.

Perhaps, everyone who makes aquarium lighting is in violation of Edision's original patent.

I love a lively discussion, but some of the moderators here are sensitive to polictical and similar issues.....They just don't want to have to separate kids in a schoolyard scuffle I suppose <G>.
