what is the question? that heatsink will be fine if you use a fan as it is intended. Are you looking for a heatsink that will not require a fan?

Its impossible to know without any information (power through the LED array, efficiency, desired junction temperature, thermal resistances between all interfaces, heatsink rating, ambient rating, airflow, etc).

The critical value is the junction temperature of the dies - which is impossible to measure. If you have the various junction resistances, you can measure the outer package thermal to determine if there is enough cooling present. Or you can be very conservative and simply make sure its not "too hot" (<< 50C for aggressive cooling) in your ambient environment.

The heatsink should have some information rating it for some amount of power. You want the heatsink watt rating to be higher than 40W. The bigger rating the better since it will be able to keep your led form burning itself.

I had bought this heatsink from a friend, he had them spare, i used 1 for 3x1w led and it worked fine... i bought 40w chip fron ebay... again the 40w heatsink is not available, but i guess if i use 50w led heatsink, it should work even better... there are no ratings on heatsink that i have... yes i will attach a fan on it...
