Stand is done I built it taller and longer than the tank to hide the piping from the side overflow...all I need to do now is add a shelf

How did you attach the pieces together? I see you'll be resting all the weight on the joints of the stand. 40g of water + sand + rocks + equipment might be a bit much for screws and nails. I personally make all my stands (did 3 so far) so the wood itself holds the weight of the tank. Take a look at rocketengineer's thread. Then again your design might be strong enough, I'd just thought I'd point this out just in case.
 
+1 on the previous post. Definitely dont want to bear the weight of the tank full on just screws and nails. 40g of water alone is around 320lbs. Granted the weight will be distributed over the 4 corners of the tank, but still would rather be safe than sorry. Maybe an engineer can chime in on the load bearing of the screws.
 
Sorry for the picture I wasn't 100% done when I took that picture, on the taller side I have two more 2x4s there and all the angle joints have steel braces with 6 screws
 
Looks good so far. I would hook up a phos reactor to start from the beginning and try to remove any phosphates that may leach out of the rock...even though you have already had it, its not going to hurt in the beginning while you let the tank cycle and stabilize.

Also the Reef Octo 110 is perfectly fine on a 40 breeder. It works very well. I would change my cup like every 2 days.
 
I ended up just getting a sca-302 skimmer and I'm going to run gfo and carbon...I'll be posting more pictures on my day off of the painted tank and finished stand, also my return pump comes in today and I'm going to build my sump

I added some more support and this thing is probably a little over done now, it's a little dark in the picture but the side with the overflow the stand goes to the top of the tank to cover plumbing next step plumb it and fill it tomorrow!!
