OT: Auto dealer legal advice

I was told by my friend that delivers new cars when a car gets damaged for example worth $2,500. This large amount would have to be reported. What the dealers do is say the amount of damage done was under $500 so it's exempt from reporting. Not sure if it's true.
 
I didn't read the whole thread because I'm on my phone but you need to take the car back asap! Just leave it on the lot and tell the manager why. Then leave until you figure out what you are going to do. DO NOT KEEP THE CAR IN YOUR POSSESION!

My wife and bought a tahoe like 6 months ago from a dealer in pasadena. I called them because I saw the deal online and thought it was killer. We test drove the car and I couldn't figure it out but something wasn't right. Finally I asked how many miles where on the car and there were 5000 miles. It was a demo and that's why it was so cheap. I was ****ed they didn't tell me before I drove down and told them to take off another couple thousand. We pretended to leave and they folded like a card house. We got the car home and my wife didn't like it. She said it smelled like smoke on the way home. The next day she took the car back and left it with them. We were ****ed because it had been smoked in yet sold as "new". Long story short... We got a brand new tahoe at the same price!
 
i would definately find a way to get rid of it, cheap body work will look a lot worse in a couple of years, when lower quality paints start to come off and the pigments fade differently than the rest of the car! then you'll be reminded of the bum deal every day!
 
joe a good tech/ painter doesnt need a magnet to check for bondo or if the car has been painted. just the way they look or color match, the edge of each panel. you can tell the car been painted. trained eye will be able to tell

How would the dealership, or even your dealership, know this car was damaged if they ran a Carfax on the vehicle, and it comes up clear? Thats all Im saying. While I feel for Bromion, it may not have been a malicious act by the dealer. In times like these, they know you arent coming back any time soon for a new car, and they will take the sale, IMO. Thats how the BMW dealership i just recently worked for was operated at least.

You have many rights under other laws that protect consumers, including:
The state “lemon law,” which gives you the right to a refund or replacement if your new or used car with a factory warranty has serious defects.

Legal relief if you were cheated, deceived, or defrauded. Consult a consumer attorney and report your problem to your district attorney.

I didn't get an email so I assumed the thread died. Good discussion!

Here is an update. I finally got on the phone with someone from BMW North America. At first, he seemed willing to help, but after speaking with the dealership, he basically backed them up. He said that the certification process does not necessarily cover investigating prior damage, poor repainting, or dent repair -- only frame damage. I STILL find this hard to believe given the FIT & FINISH written in capital letters on the BODY section of the CPO inspection form! So, basically, BMW North America is going to be no help.

Even worse, if this really is their policy, then the CPO program is kinda a scam. I mean, I already know that their extended warranty is a scam (doesn't cover all the very expensive wear and tear), but if the inspection doesn't even have to report properly what's on the form... what is the point??

I am speaking with an attorney ASAP. Since the word from BMW, I feel I am in murky waters and may need representation.

To clear up a few questions:

1) Small claims limit for individuals in LA county is $7500. I would be suing for cost of repairs and diminished value, which would total under $7500. Maybe punitive damages would bring it to the max.

2) The CARFAX was clean and there is probably no frame damage (according to my mechanic, who didn't spend so much time on it since he spotted the shoddy body work off the bat and didn't want to charge me for an inspection until I was certain I wanted it). I assume the car was struck by something (possibly another car) or it struck something like a pole that did significant body damage to the driver's side. That warranted the repaint and the dent repair. Of course, it could be that the previous owner was a terrible driver and had multiple incidents. Dunno.

3) My mechanic spotted the mismatched paint from across the parking lot before I told him anything. So did his assistant. The BMW Monrovia manager acknowledged it just by looking. Nobody who is doing a "certification" that includes FINISH should have left that off the report. As they advertised it as certified, they should have disclosed it. Hell, even if it hadn't been certified, it should have been disclosed, but had it not been certified I would have had the car inspected and never bought it in the first place!

4) Carfax guarantee probably does not apply here. They basically guarantee that their records match the DMV/state records. If this was a minor thing or series of things, then it would never have been reported. No doubt, the previous owner did not report this to the insurance company, otherwise it may have shown up on Carfax depending on the circumstances.
 
the same exact situation happened to me..the carfax they gave me was before the accident. we could see the crappy paint job they did. but they agreed to repaint it if we bought it. they swore it had no accidents previously. but as we were going through the finance info, they scrolled passed something about the repairs the car has had. and saw that the hole passenger side was damaged in an accident and had bondo swirls that were visible. it was just a lucky chance we saw it while they were scrolling through the info quickly. luckily they repainted the hole side, unluckily they scratched the car while doing it..check the clips inside the door panel and you can see if they are broken, mine were..if they didnt show you valid carfax/history then you can definitely show that in court. pm me if you want any info from my experience. funny if it was the same bmw dealer :D it was bmw riverside for me. HA
 
Personally I wouldn't buy a used car from a public company where the GM is just hired help. Different story on a new car though.
