OT : bad news

we called lawyers and yes it works that way....if she is unable to pay her bills the nursing home can take the house away, unless about 5 years back she has signed away her home to my wife or to me.....this is the way all nursing homes work, however we also found out through "elder laws" that there are loop holes on this....being that my wife has cared for my mother here at this home for 5+ years that through medi-caid that we may be able to get and keep the home....if that doesnt work out which it should.... a child related to her that has some sort of disability should be able to get the home as in our daughter who needs dyalisis in order to live.....so like i said we called a few lawyers and hopefully will hear soon about this so maybe there is hope to keep the house :D

"5 years back" is the key here.

Sorry to hear your daughter requires such treatment. That must be very difficult for her to deal with.

As far as getting the house because of the disability, you may still have problems. They will likely look at you and your wife's ability to take care of your daughter, not the grandmother's. I assume you and your wife are not disabled and are capable of working, especially if you are no longer caring for the grandmother. Also, given the fact that you and your wife were just able to purchase a new car doesn't help matters when asking for financial help.
 
yes but see frankly alot of us are able to get a number of cars easily...this one is only 70 bucks more a month.....this car or the one before it is still a stain on money, having said that, this law im talking about may not be part of the tenneessee laws, we just got back from the nursing home and even her van is up for grabs by them....i am still hopeful that there are a few loop holes in the laws that we can take advantage of here, though im thinking we might only have a small window here to do so, however all this is looking like we will need section 8 housing....we are going to check into that tomorrow and also talk more with the nursing home people in a meeting we need to go and sit in on and maybe hash out a few details......and gonna call a few more lawyers that deal with these matters and know more loop holes then ya regular lawyer and such...also thank you for the kind words bout our daughter...she knows shes been sold a bad bill of goods,but she believes that God has a plan for it as he does for all things
 
When applying for section 8 they look at all of your assets, including your car. I have doubts you will qualify for section 8 while driving a 2010 vehicle.

What you may want to look into, if you haven't already is social security benefits for your daughter. It might not be much, but it may be enough to help pay rent.

Many areas also have programs available to take your daughter to and from appointments to get her treatments. This will allow you to have the car to go to work. It will also help keep your family out of Section 8 housing.
 
Mario, My wife is wheelchair bound and Cumberland Transportation picks her up and brings her to all her Doctors Appts and to the Pharmacy and back home all for 3.00 each way. You need to call them 24hr in advance to make reservations for all appts. I'll see if i can get you the # and PM it to you.

thanks Bill i appreciate that and will call em to get more details as soon as ya get me that number though other things come into play, being that her disability is not just that she cant walk or something like that and has to deal with blood issues and other last minute emergency issues due to not haing kidneys, plus her being under age my wife needs to be with her on all her trips and such, also i didnt know about ya wife, im sorry to hear that, i hope all is well or at least as well as can be expected, but i will still check into that Bill thanks....also guys i saw that in franklin there are hud appartments that we can look into maybe but we dont know the area.....its the harpeth hills appartment and was wondering if any of ya know bout them?

our daughter has been this way since she was 3 and is now 14 and has has social security.... as far as being helpful....youd be amazed by how little one gets even though you need dyalisis to live

Don't give up if this one doesn't work out. There may be other places that can transport your daughter, along with your wife, safely.

As far as getting an apartment, hold out as long as you can. It may be many months before you have to move, possibly years. The nursing home may only place a lien on the home.
 
yea the woman at the nursing home said they may put a lien on it in which case that will help use out alot and as far as ssi goes thats not an option though things are some what ok so far as i have crunched numbers....the biggest hurtle to get over is the house thing
 
Since your not working, why don't you just take care of your mother in law at the moment until you guys can crunch up some numbers to work with? At least you won't be forced to move anywhere if she stays with you. Like the number Bill provided for you, use it for your mother in law's transportation for any needs possible. I know it's a lot to ask to care for someone 24/7 but you must look at the big picture for the wellfare of your family. During the period while you are caring for her, she could sign the house over to your wife. Sure it takes 5 years to take effect for them not having to put a lien on the house if she needs to go into the nursing home after 5 years so your family can put your life back together. But 5 years flies by pretty quickly especially if you guys are good on bills right now with you not having a job. Sometimes you just gotta do what you gotta do. You may see me buying whatever I wanted to, but I work hard to get where I am today. For many years I work 70+hrs a week with no vacation, no going out doing nothing, just work and home. I do what I must do so I can live a little bit more comfortable right now not having to work that amount of hours. Just something for you to think about.....
 
mike as of right now we have no control over my mother in law....the nursing home and such state now if she is capable to come back home or not....also the only ones able to help her are the kids and paula......she doesnt want me doing the things that are needed......its not like she just cant reach the remote or something, she is really bad off and her not trying as much as she can makes things worse because her body gets used to that and then becomes very hard....honestly she needs more care then what she can get here.....good thing is if she did come back we might can get medi-care to help fore a while with what she needs and after that hospice to help out....we will be talking to a social worker for this stuff hopefully by next week and there she/he can answer our questions about the house and van that are under my mother in laws name.... and trust me i've been a district leading manager all the way to a burger flipper so i know that i gotta do what i gotta do lol......if any of ya hear of any jobs just let me know via PM :D
 
UPDATE:

we just spoke to 2 lawyers that strickly deal with this kind of thing and they said the nursing home can not take the home or put a lien on it unless she passes away and even then we could get it if my mother in law gifted paula the home and we paid a tax % based on a internal/external inspection of the home which probably wouldnt be more the say 6,000 or so.... or another way is if my mother in law put paula in a will stating that she will get the home,but paulas brother would also be put on it as well..... i love the first option best, but we dont have that amount of money laying around.....but it seems as if we may be safe for now unless she passed away
