I bought a skimmer from a guy here on RC sent from TX. Of course it comes broken so I file a claim online and call UPS. The UPS lady is immediately defensive with me, then goes on to tell me that I didn’t hire UPS, the guy I bought the skimmer from hired the UPS Store which actually hired UPS (the ups stores are franchised). So at that point, UPS would pay the UPS store which would at that point have to pay the guy who shipped the package. WTH? I thought insurance was to protect the person the package is being shipped to, once it is delivered to me it is MY property, right? Nope, should UPS decide on their own good will to pay up, the insurance only makes sure that the shipper receives money. Now that guy will have my $300, UPS's $300 AND his broken skimmer which he can probably fix and sell to make another $250. The guy seems pretty cool so I'm hoping he makes good on it, but wow I didn’t know that as a person receiving a package you are so very little protected.

yeah i found that out the hard way too...i bought an aquac skimmer with waste container off some guy on ebay. The waste collector was broken so i called ups and they reacted the same way as you stated. They got all PO and they said the exact same thing that i wasn't their client. So i sent the waste collector back and never heard from the guy or ups again.

See that's what I tried telling the lady!! "You want to come pick up my broken product and not give me anything for it??, Then how do I get resolution??"
Response: "You have to take it up with the shipper".
I tried explaining that it was just a guy I purchased it from, she said that's my fault and I need to be more careful. I told her UPS needs to be more careful with my packages!!

She also told me that if I want to get lawyers involved then they will be on UPS's side (I didnt mention taking legal action). What is wrong with that company???

I'm so ****edoff at UPS right now!!!

the contract is between the shipper and UPS. the end recipient really has no say.

Not to play devil's advocate, but how do you know the shipper properly packaged the product? Or that is wasn't broken to begin with?

I know he packaged it properly because when I opened the box it look my 5 minutes to get through the hard styrofoam around the entire perimeter, bubble wrap, and packing peanuts. Of course it could have been broken before he put it in the box, but I think that is not true because he has been good to contact me quickly and let me know that he used to build acrylic aquariums for a living and suggested ways to glue it back together very cleanly. We just agreed that he will pay for me to take it to a plastics shop here where they will professionally repair it at his expense. I am lucky that he is being so cool about it.

yeah ii worked for fedex for 5 years as the Rcpt you are nothing to the shipping co as you did not pay to have the package shipped... what you are better of doing is sending something FEDEX BILL RCPT Hold at station for pick up.. that way you are the "MAN" and as you open the package in front of the fedex person they can put a "delivered damaged" scan on it so you can get paid for damages.. remember pkgs are only insured for $100 any more than that you have to claim the value prior to shipping...

What if I had someone use a FedEx/UPS account number in my name to ship? Is that even possible or secure (since I wouldnt want them to ship anywhere ele except to me)? Would I be covered then? By the way, it was insured for $300, but at this point it's pretty much worthless to me.

yes if you have an account number you are the man.. fedex will cancel charges to the account that you prove are not yours..

if i were you i would get my money back and forget about the skimmer... how did you pay for the skimmer?

Paypal. But I just took it to a plastics shop and they fixed it, looks pretty clean. Hopefully it holds up. It just sucks that the shipping companies leave you hanging like that.

If it's any consolation, that's standard practice. Same goes with USPS, Fedex, etc. The shipper buys the insurance, and if it arrives broken, the shipper should pay you back.

To take advantage of this policy, companies like PayPal offer money-back guarantees for a fee. There are also online escrows that basically do the same, also for a fee.

Ha! You think that's bad? It once took me a year and a half to get back $2300 for a laptop I shipped to an APO box via good old US Postal Service. So much for the "insurance." The lady at my local PO (who was pretty helpful through all of this seemed surprised when they actually agreed to pay the claim (after 12 months) and I was surprised when I got the check (after another 6 months.)

I would have went Postal!!!
