I just got back from my week long flyfishing trip to find out there are some problems in the ranks of our membership. I feel that we are all friends in this club, and think that friends should treat each other with the respect they deserve. Writing bad checks is not respect, it is wrong!!!

I would normally not post something like this on the forum for everyone to see, but I don't want anyone else to be hurt personally or financially by the actions of others.

It has come to my attention that Lin (Lfduty) and Kendra have been writing bad checks to at least three of our members. These checks have been out since the last meeting (07/21/07) and no attempt has been made to make good. One member had to go over to Lin's house to get partial payment in cash, but the others are still out their money. One check in particular is for $300 + bank fees. Luckily these members had enough of their own money to cover any check they wrote after depositing the bad check.

At this time, the Board of SCMAS has discussed this issue, and I have made a decision. Lin and Kendra will be suspended from being members of SCMAS until restitution is made (including bank fees) and until Lin and Kendra have requested to be members again. The Board will then vote on the issue and reinstatement will be possible.

As President of SCMAS, I truly hate to be the one to have to make these tough decisions, but it does need to be addressed. If anyone disagrees with this process, please let me or one of the other Board members know.

Again, I am truly sorry that this has to be brought out to the membership of SCMAS.

Not only is it wrong, but illegal and is also known as theft by check.

If restitution is not made, charges could be filed and the penalties in Colorado are as follows:

Misdemeanor - imprisonment in county jail for not less than three months nor more than 12 months or by fine of not less than $250 nor more than $1,000 or both.
Felony - imprisonment in state penitentiary for not less than one year nor more than 5 years or by fine of not less than $1,000 nor more than $15,000 or both. If twice previously convicted, punishment is imprisonment in state penitentiary for not less than one year and not more than 10 years or fine of not less than $2,000 nor more than $30,000 or both.
