bummer from UPS!!! a bunch of theives!

Good luck. I'm not sure you have much of a claim. How did you even let the driver get off the porch? You couldn't tell he handed you an empty box?
 
the box was pretty large, including a tripod, camera bag, and some other parts, so I could not tell immediately that the contents were missing - if only I could see through cardboard!

...clearly the thing to learn for all - if the package is even a bit damaged, as this one was - you must refuse the package. (I was not aware of this, expensive way to learn this lesson), Then, you have to take off a few hours from work, go to the depot and accept the package and deal with it there. This is obviously hard to do when you are excited about the contents of the package and its the day before a holiday when you wanted to use said contents.

...on a second note, I wont ever ship to my home address again - Work will now be getting my packages.

So now the discussion is what exactly is implied by signing for the box. Does the signature cover delivery, delivery of the box, delivery of the box and contents, delivery of the box and contents in working order. (this last part is mostly joking)

I am sure that UPS has a very clear legal definition of what a signature on either document means. This same game plays out over and over every day :)
 
I agree, that once I signed for it, both the seller and the Bailee were relieved of some of their duties. But I am allowed reasonable time to inspect the good and in this case the goods were non-conforming goods.

done here - Ill update again when there is some actual information instead of speculation.

...again - lesson to me, and to all of you - if there is any damage to the package, refuse it on the spot. It sucks, but that's the truth.

Sorry to hear your situation.

I agree with Grace's Dad... what's up with that nonsense? How could the package be re-delivered if you already accepted and signed for it the day (or days) before? This doesn't make any sense and I would imagine if you pointed this out to UPS and/or B&H it might help turn the tide in your favor. Unless you're doing a really bad job of explaining this, and I'm not saying you are, but unless you are something very suspect is going on at UPS.
 
...I will complete the story.

So the camera and lense were originally missing from the original box that was delivered on wednesday the 26 of November. The remaining contents were all in the box.

I filed a claim with UPS and B&H. Unfortunately there was very little communication from either side, about the claim.

UPS stopped by on the 1st of december and picked up the original damaged box with the remaining contents of the package. This then went through claims.

The box was then redelivered to my house on dec. 5th and signed for at 3:50 Pm. (the problem is, that I was not told that the package would be re-delivered, nor was I home to accept or sign for the box. So when I called UPS yesterday to get an update, they told me that the box had been delivered on this date and signed for by me (this was the first time I learned about the redeliverd box). I was thinking ***!!! How can the same box be stolen twice!)

I called B&H yesterday, but my claims person was already out of the office, So I called again this morning and this is what occurred:

First, they tell me that they are going to send me a new camera and lense! This is great news obviously. I stop him, to let him know the rest of the bad news, that I don't have the rest of the contents. The guy, literally is silent for a second, and asks me to clarify - so I tell him that I called UPS and that the box was delivered, and "signed" for by me on the 5th, but that I didn't sign for it, or receive that package. He is shocked at this and asks me to hold on to take a look at the signatures. The signature on the 5th is a circle - my other signature is very clear, I always do this, and he just laughs, saying that he cant believe the same box would be involved in two thefts - I agreed!

So, on Monday, they will finalize the claim with UPS for the remaining parts (tripod, camera bag, lense covers, extra battery, memory, etc.) and ship it to my work address so that I can receive it by Friday the 19th, so it can go on vacation with me.

So, I will get everything, but the package was involved in not one, but two thefts! Everything is missing and I will, in theory, by next week have a new set of everything I ordered.

UPS has lost a customer, B&H kept one.

That is awesome - great outcome. I think if I ever order from B&H, I'll encourage them to use an unmarked box so it isn't so darn tempting. :D
 
I'd have something shipped to you (or even a BH box) with a camera or camcorder one day and wait. See who "steals it." :lol: I'd get a laugh out of it.. then turn him in.

Glad everything worked out alright, even though it took some time!

Wow glad you got your new camera so how about some new pics. Can I ask you what made you decide on the nikon. I am considering the 50d or the 5d Mark2 but don't know if the video is really needed

Glad to hear it worked out.

Do you live in a high crime area? Weird that you got robbed twice, although someone got some good equipment the first time, so the second time around they probably thought they would be as well.
 
I think it might have to do with UPS usually during this time of the year they usually hire a lot of seasonal employees.

Oh I'll agree with that, B&H has the best service around whether you have a problem or not IMO. My first words in this thread waaay back were "I bet B&H saves the day". I just knew they would.
 
I'm glad that you'd got it resolved! I just got my D300 from BH last week and saw your story so I was really paranoid.. when the UPS guy delivered the package, he had to wait for 10 mins IN FRONT OF ME while I check EACH box content before I signed... lol

But congrats!
