Have you put in the tank and let it settle in for a little while and see if the polyps come out?

It doesn't look healthy but to me it does look alive.

Yeah I had it in there, but took it out to take a picture for their return policy. It has a thick black ink oozing out of it and some of the polyps have already fallen off.
I was afraid the ink may hurt the fish

The ink won't hurt the fish but is probably brown jelly disease. If so, the protozoans in the "ink" could spread to other LPS depending on what they are--wall hammers, torches. Wall hammers are the worst for this.

You probably should have taken the pictures of it in your tank.

Yes it does look like a gonner to me. I agree with wall Euphyllia they are very prone to brown jelly mostly on the ones that have been fragged IME. I recently got a full wall hammer so we'll see how it goes. I only got it because it was the full wall hammer, never been fragged. I will never buy another wall that has been fragged, as far as the full colony, we'll see how it goes.

Yeah doesn't look like it will last much longer. I also had a wall torch slowly degrade and die on me while the branching torch next to it was carrying on happily.
