This is the CORRECT information.....don't get caught without a license, or over the bag limit, as they will take you to the Key West jail, and it has no a/c...not a pleasant place!

They are VERY TOUGH in the Keys, and no excuse will keep you from being arrested, it is their JOB, and they do it well!

I have been stopped by five different enforcement agencies in ONE DAY, down there before!

If you read the last link it defines cobia, sea trout, snapper, etc as restricted species, but I know for a fact you can keep them as long as they are the correct size.

Restricted species is a designation for animal which are covered under the "restricted species" list......you MUST have a SPL"saltwater products license", with and "RS" endorsement AND an ML endorsement to exceed the recreational bag limit...for animals on that list....and there are 3 types of ML licenses

MLD full blown collect anything diving/ wading/snorkeling
MLB bycatch, as if on a shrimpboat and keep animals caught in the net, but you cannot dive snorkel with a MLB, you can walk the beach and collect with it.

MLC Marine life Curio.....for collecting RS shells...no diving/snorkeling

That's not true Liverock. I had the commercial license. It's the restricted species permit that you are making reference to.

HOWEVER - I can end this here and now.

I just happened to get a call from FWC today concerning another issue and so I just called that number back and asked the guy directly.

You guys ARE correct and I WAS correct (with explaination).

When I went down that road I was looking to collect in order to sell and SELLING is what makes the difference. I got the answers I got from FWC because my intentions were to sell.

YOU CAN COLLECT THE BAG LIMIT OF BLUE LEGS FOR YOUR OWN USE.

If you intend to sell them to a friend or commercially then you will need the regular license, commercial saltwater products license as well as the restricted species permit.

Sorry for the confusion.

You can ONLY keep them IF you have an SPL license WITH a RS endorsement........you DO not need an ML endorsement for those fish...

and in addition to sell you MUST have a Wholesale dealers permit, called a WD license, cost $350.00 to sell animals commercially...

Trust me, I know!
 
Oh gee...this is too complicated now....the final judgement is that we CAN collect blue legs if we don't sell them. :)

Yes that is an SPL..BUT you have NO RS endorsement, so you cannot collect anything that is on the RS list....

Only way to get an RS endorsement is to qualify for it...which means you must have $5000.00 of sales of RS species, documented with Florida Trip Tckets to qualify...but if you cannot collect RS species without a RS endorsement, how do you get one?

you have to work on a boat with an RS endorsement, and document with"crew shares" for yourself, and reach that $5000.00 mark in one year to get an RS, or your outta luck for that year..

It "was" going to be a little side business simply selling blue legs as I have a normal 60 hr/wk job.

Didn't work out that way. I'm actually glad this came out in the open because I just set up a new 150 gal and will need a clean up crew shortly.

what you had was basically, the same as a regular fishing license, as you have no endorsements......you got some bad info, and they got your $75!
