New Tunze Mini Osmolator intermittent

Hello... I have the new small version of the Osmolator on a 40 gallon Innovation Marine all in one tank.

I have the osmolator in the attached sump, in the middle outlet pump section of the sump, as this sees the water level change the fastest.

I set the unit up, and it worked fine. But later that day, I can in and the water level was one inch below the float, and the float was in the full downward position. I move the float a bit, nothing happened.

I unplugged the unit and plugged it back in. Bam, it comes on right away, ran for about 30 seconds and filled the center section, float went up and it shut off.

While sitting at my desk, over the course of the next day, I heard it come on several times, each time it seemed about 30 seconds.

Then at the end of the day, I go in, now 1 inch below float, float in full down position, pump not running. I unplug the unit, plug it back in, it immediately starts running and in 30-40 seconds, sump is full, unit shuts off.

It seems intermittent... I can go play with the float, move it up, pump comes on, move it down, pump shuts off. But sometime during the day, I will go in, and the float will be in full down position, water level low, and I have to unplug and replug the unit, and then it will immediately pump.

I have the jumper in the off position (non factory setting) to get the longer flow time before a shut off. It sure seems like I am hitting this limit, but I can't see how... even with the water level 1 inch below the sensor (when it fails to work) I only have to unplug/replug and it fills up the center section in 30 seconds. So I can't see how it could possibly be running for more than the timeout period normally.
 
I know the issue and it is a bit complicated but I have a simple resolution, can you email me the receipt to Tunze at sbcglobal dot net?

Basically, the pump manufacturer changed the motor without informing us, it needs more power on start up and trips a safety on the controller. It is easily solved by just changing the software on the controller to allow a start up spike, but a special programming terminal is needed so it isn't a DIY fix. We caught this pretty quickly but some units went out with redesigned pump and old software, I will exchange your controller.
 
So what am I going to have to do? Mail this back? I'm not going to do that. It's defective out of the box, I'll take it back.
