I dont know where or if I should put this on here. Please KINDLY let me know if it shouldnt.

I Just got into a car accident and I dont think they have insurance. Policy # they gave me doesnt bring anything up and the insurance agency they claim to be with, Shows the policy expired over 6 months ago. They called me back and said there was something going on with the policy. I am still waiting.

Was not my fault, They pulled out in front of me from a parking lot, while I was in the right turn lane.

So I was wondering if there are any laywers in the group that would know about laws like this and what my options are.

SO if anyone know's a really good attorneys or someone is within the club, could you please message me.

And I am alright, Just totaly heated right now and nerves on edge.
 
the best thign for you to do is call your insurance company and let them deal with it. do you have a police report? if not file one. you pay your insurance company to take care of these problems to reduce the headache for you. I just dealt with a similar situation and all i had to do was take my care to a shop, it was dealt with and that was it, the insurance companydealt with everythign else
 
Definetly have to agree with SLO on that one. Assuming you took down his name and information straight off of his license then things should be pretty simple.

Since it is illegal to drive in CA without insurance he faces possible jail time. This will no doubt be said by your insurance company to him if they have any communications with him. Hopefully, that will encourage him to settle the issue outside of judicial means, but then again, if he doesnt have insurance he may not have the funds to afford the damage. Hope everything works out for you.
 
Yep, let your agent do the work. If the bum can't afford insurance, a lawyer won't do you any good, what are you going to get from him, his wrecked car? Assuming you (and kids) were not hurt, count yourself lucky.
When an uninsured bum hit my car (a parking attendant at my work clobbered my parked car with his truck) he lost his license, and therefore, his job but there was no jailtime. I think they have to be drunk or hurt someone badly for that.
Bad news, if your uninsured motorist coverage pays for it, your rates go up, and you end up with nothing more than a guaranteed loan. It wasn't huge in my case, but the rate hike pretty much equaled the amount of my damages check over time.
 
You're likely $#!^ out of luck if they turn out to have no coverage. If your insurance company can't recoup, then you'll have to cover your own repairs if you have a deductible.

Unfortunately, there are times when you abide by the rules, and you still suffer:(
 
Yeah, But I didnt have uninsured motorist on my car, I own it out right so I dont need full coverage. (which I may end up using for future, It always takes something to happen for you to act on it)

They still think they are right and I am at fault. Even though my insurance states and the police state he was at fault.

He plans on taking me to court, which I hope he does. He can pay all those legal fee's, The father threatened physical harm to me, which I can use in the lawsuit also. I assume naming both parties in the suit.

Even if they dont have the money, it will still have a judgement in my favor, which I do believe they may garnish wages and such.

But this Is why I wanna speak with a lawyer, I know there are tons in the phone book, But I have never needed to deal with one.

So I am looking for recomendations from fellow friends and members.

KIds are fine, it was only me in the car. I Just got off at work when it happened. The kids works for Apple also, But in one of the warehouse's. He is only 19. Sheeesh

Report the threats to the police, they will stop that and it won't help their case any. Write down everything you remember about the whole thing without discussing it with anyone else. I agree with Karl, don't post any details in any online forums. Any of the big Yellow Pages ads for accident/injury law firms can give you an idea of your chances. Don't rely on somebody's buddy who works for a lawyer.

i had a similar issue before. your best bet is to take them to small claims court. be sure you have all your information and organize it well. i went to a lawyer but they didn't want to help since there wasn't any money in it for them. so i ended up doing it myself. was very organized and had drawings and everything. won the case and got my $$$ from them. be careful however since i was also afraid of takeing them to court since they threatened me too. by going to court they will know where you live so be wary of the situation. i lucked out an moved right after.
