OT- Speeding ticket and court

Hey, well I just got my second ticket within 18 months and Ive already gone to traffic school, so I am facing a point on my record :( It really sucked as it was off the 40 in the middle of nowhere at 1 AM on a Thur, but I guess it was my fault for not obeying the law... shame on me.

Anyways I was wondering if any of you had experience with fighting a ticket just to try to beat the system? I heard (as Im sure most of you have) that if the arresting officer doesnt show up for court the ticket would be dropped if it is faught, is this true or is it an old wives tale? I hate being dishonest just to weasel my way out of a ticket but I hate having to take a point on my record even more.

Which leads me to my last question, is having a point on your insurance really as bad as everyone says it is? How much does it bump payments up?

Any info or thoughts would be much appreciated. Thanks

We have beat 4 parking tickets but have never been able to beat a traffic ticket.Both times we(I went as a passenger/witness) went to court on traffic violations,the officers turned out to be "specialized" traffic enforcement officers and the court sided with the officers.

I can't help with any info regarding points since fortunately,it's never been me that has received a traffic ticket :)
 
I have 1 point (well 2 by now) and my insurance did not increase. I have 21st century. It even says on my insurance cert that I have a point. The funny thing is I am still getting a Good Driver discount. Its probably cuz I went my first 8 years without a ticket.
 
you can try it but from what I've heard the cops like going to court.

My wife was speeding home from work one day and got a ticket for speeding in a construction zone..she was so mad she told the cop she would remember him seeing how she worked as an ER nurse at the local hospital. The cop went back to his car and then returned, he told my wife he could not rip up the ticket but he would not show up for court on that day.....Sooo, my wife goes to court and guess who's there? yup, the cop who gave her the ticket. She was so scared she almost cried. When it came down to it the cop told the judge he could not recall giving her the ticket and the judge threw it out...I guess cops don't like to give ER nurses tickets, specially if they work at the local hospital.
 
if i were you, then i would wait till 5 days before you have to show up to court and call in to ask for an extension. that will give you an extra two months. 5 days before your next due date, call in and tell them that you want to do a written declaration. they will then give you a month to finish your written declaration. by this point (5 months later), the officer will not remember you. all you have to do is write 'i plea not guilty' and turn it in. the officer can't write an opposition because he won't remember the exact things that happened during the event of giving you a ticket. nother thing, officers dont get money for written declarations done through mail. they only get money for going to court or if you pay your bail and go to traffic school.

DO NOT WRITE, 'IF THE COURT DOES NOT AGREE WITH MY WRITTEN DECLARATION, THEN CAN I PLEASE GO TO TRAFFIC SCHOOL' BECAUSE THIS WILL GIVE THEM THE IDEA THAT YOU ARE POSSIBLY GUILTY. actually, this wouldnt apply to you because you cant take traffic school anyways.

once this happens, you are free from your ticket. or in any event, that does not work out. you have another chance to see him in court. if he doesnt show up, then you win.

I DO NOT GUARANTEE THAT THIS WILL WORK. but after googling and doing my research for my ticket...this is the best solution i've come up with. i'm currently in the process of doing the written declaration....ill update you on my progress if you want me to.

haha wow Bill, that sounds promising, and elaborate, and I think thats exactly what Im going to try to do.
 
Does anyone know of a ticket attorney in the LA area? There used to be a guy in San Diego called Mr. Ticket. I need to find the same kind of guy in LA county.
 
I heard somewhere where you pay the bail amount plus a few dollars extra. The court will send you a refund, just don't cash it. It seems that if the check doesn't clear then they cant close your case# and they cant assign you your point. I don't know if this works but my brother is going to be trying it out this week.

Do not go into court, do a trial by written declaration-this way you can straighte out your story on paper rather than in front of the judge.

What did you say when you were pulled over? Did you admit to your speed?
 
You can request second offenders traffic school. This one is 12 hrs long and may take 2 saturdays i believe. Kiss the judges butt and request it again.

No need to go to trial and all that nonsense when you were in fact speeding. Your not only wasting your own time, but the officers, as well as the courts time.

If it was a BS ticket and you were ticketed for going 35 in a 45 or 45 in a 45 then fight it, otherwise request traffic school again.
 
If a radar gun is involved, you can always request to see the calibration of the equipment when you go to trial. If it's not within calibration specs. or expired, you're home free.
 
You will still get a good driver discount with 1 point or less but your rates will go up very little. 2 or more points then your insurance rates will go way up. I had lots of tickets during my teenage years and tried to fight the ticket. You will have a 50/50 chance of the cop not showing up and the ticket gets dismissed. You can file for an extension (up to 2 times in most cases) so hopefully the cop will forget about you by the court date.

I wouldstill go to court even if I had a chance to go to traffic school. If the cop shows up you can still change your plea to the judge and request to go to traffic school before your trial begins. If the cop doesnt show up then your case gets dismissed.

I think the "How to fight your ticket" book is still in print. Check Barnes and Nobles or Borders for this book.
 
i did what sir light did i requested traffic school 2. It is up to the judge to let you go but if he does let u go u wont get a point on your record.

ps if i remember right the traffic school cost more and is long luckly i have a frend that owns a traffic school lol
 
if it was a chp that ticketed you he gets paid to go to court and fight it.
cops do write notes about the incident so they can reconstruct it later if they have to go to court to fight you.
 
I had a point before on my record and it barely raised my insurance... I asked my company and they said if i get more than one, the it'll jump up like crazy.

Thats why its a good idea to say nothing if they ask you how fast you were driving, why you are in a hurry,etc. That will just strenghten the cop's case even more

If you have time you could go to the court you have your ticket with when traffic cases are heard. That you you get a feel on the percentage of the ticket that gets dismissed and a feel on what to expect.
