OT- Speeding ticket and court

Just go into court and request 2nd offenders traffic school.

Usually they give it to you unless you were doing 90+ in a 45 or something asinine like that.

Dont try to "beat" the system. You will fail, you will be fined, and you could face incarceration.

Man up to your mistake and do your punishment. As i had said earlier, if it was a BS ticket 45 in a 45 under perfect conditions and everything else, build your case and take it to trial.

Yes the officer could be taking off, but at the next rest stop, he's probably going to write it down. The officer would be stupid if he wouldn't. The officer's stupid if he stay at the same place and write stuff down. Officer safety.

I carry a small tape recorder on me at all times, and it record the whole 12 hours shift. At the end of each shift, I mark the tape, store it and put a new blank tape back into my recorder. Department pay for it and encourage the officer to use it more often.
In and out of court for the last 6 years, I've used it on 99.99% of my traffic case. Never have any problem. Its so funny to see the defendent face when the recording play back in court. Yes it's the law that you have to let the person know you are recording, but there is always a trick to go around it. I don't know if you're aware that a ticket is consider an arrest and release, if you don't sign the ticket, your a@# would be in jail. But when is the last time the officer read you your rights before asking how fast you are going or why you didn't stop at the red light ? the law requires the officer to read the suspect/defendant their rights before asking any question that related to the crime.

However, we are talking about traffic citation and not criminal. Traffic violation is consider a general intent crime, meaning you don't have to be aware or knowing to committed the crime. Therefore, most of the criminal law doesn't apply. Beside who say I am recording you ? I am recording my conversation for my protection. So when in court the defendents 99.99 % will say that the officer is wrong and harrassing them, to proof my case and my innocine, I'll pull out my tape and play it to the court.

Tape/ video recording are 100% accurate in court. That is why alot of officers are getting in trouble. I thought the law requires the person to be notify of such recording. Anyways, 99.99 % of the times your converstaion is recorded and this is part of the officer safety and protecting the officer.

You can try all you want, it doesn't hurt to try. Officers are notify of traffic court 1-3 week in advance, they have pletty of time to go back to their file. Beside, maybe 1 person out of 50 or 100 decide to take their case to court. Out of 100 person in traffic court maybe 1-5 person will get off, this is due to officer not showing up or he or she is stupid for not preparing.

The court will be on the officer's side 100%. If you have previous record on your DMV file, then good luck to you.

Don't underestimate the technology, I heard that there are video camera that install on to the officer patrol unit and it will run your plate automatic no input needed. Digital ticket machine that capture your picture or finger prints run it in clets system for warrant and stuff wireless. Radar that can read both ways of traffic...
 
Just to be clear, I was speeding. I do not deny that, as I stated in my first post. And I am not trying to whine about it either, I just wanted to know a little about the rules of engagement, if you know what I mean.

And for youll to say taht this is a "waste of bandwidth"... thank you for careing about your friends on this site. It means a lot to me to know that you guys really do care about us.
 
I'd do the extentions for as long as possible. Then show up to court. If the officer is there argue basic speed law. As long as you were under 55 and there were no dangerous conditions you will be fine. I have beat 4 tickets like this.

I also looked up to see if there was a new survey done after any road construction, they need to resurvey the road to maintain the same limit. The calibaration on the gun works well.

The only time I ever lost I was going 48 in a school zone and got popped. I did the extentions and the rest. Got in to court told the judge my side, that school wasn't in session that day, so I thought it wasn't a school zone, he stated the law from memory and asked if I'd like to change my plea before he ruled. :)

I know I need to slow down. But I haven't even been pulled over in 4 years. I just had a fast moving youth.

I do care, not only about you but the others around you. These limits are imposed for a reason as I'm sure you know. Regardless of what some may think it's not just to keep you from getting to your destination on time but so everyone on the road gets there at all.

I'm very concerned about you & your family, me and my children as well as my grandchildren, and even those people I've never met before. Those that set the speed limits and those that ticket you care as well otherwise we would'nt need the laws or the enforcers.
