Recourse

I bought something that was damaged from someone on a board like this. The guy basically said too bad. I paid via my credit card through paypal. Do I have any recourse???

Thanks, Adam

Damaged in shipping or beforehand? Contact your CC right away, keep copies of any correspondence from the seller. Take pics. Paypal seems to be worthless, but let them know also.

Damaged beforehand I assume...and yeah paypal already closed my dispute, they are worthless like you said. Just lost all my faith in their system regarding security. Just seeing if anyone else has had a similiar situation like this and what the outcome was.

Like they said contact your credit card company. They will contact the seller and ask lots of questions during a recorded call, most people this sis all it takes to get the truth. Also if it is worth it they will go after him legaly if the dollar amount justifies the expense.

good luck. I had a guy sell me a broken tek fixture. I went after him every way I could think of including USPS, CCC, Paypal complaint, Sheriff, and in the end I think I wasted a lot of time and only succeeded in giving him more satisfaction since none of my efforts resulted in a refund. Don't buy anything from a guy named 'lotsofgallons' in FL....

I also had a local (ChuckNorris) sell me a busted Mag pump. No refund from him either. But that was a cash deal.

You paid with a credit card through paypal? How did the credit card company respond?

The deal with Paypal is they will "investigate", basically they ask you your side they ask the seller their side. If they shipped you something working or not, the seller has met their obligation. If you have your credit card company reverse the charge, you can do that but Paypal will cancel your account because you are essentially sticking them with the charge and they don't like that. For the most part, if you use PayPal outside of Ebay, you get very little protection.

I'll stick paypal with the charge if I have to and figure out a way to open a new one. They looked at my case for 30 seconds and then closed it, not much for protection there if you ask me.

Already filed a claim with the credit card company...this is the 3rd time I have been burned on a deal like this, I'm done. Only local action for me for now on!!!

If you have any money in your paypal account, I'd remove it. I'd also disassociate it from any account that has money or credit in/on it. You could almost anticipate that they will come after you for the money once the credit card company reverses the charge. I might even go so far as to remove the funding sources and close the account now since Paypal will likely do it for you anyway. I wouldn't be surprised if Paypal went all strong-arm and started sending you a bill which would eventually go to a collection agency.

I can offer some insight on this. I work at a credit Union and my wife was in the fraud department. We file a dispute with visa against PayPal pretty often, and I've actually done one myself. Depending on the dollar amount, visa will just do it and write off the loss. Sometimes the issuing bank has to take the loss for you, just one of the things you have to deal with being a Visa provider. Once the dispute is filed PayPal has 30 days to respond. If they don't fight it you will get your money pretty quickly but if they do it can take an additional 30 days for Visa to make a decision.

That's interesting. I don't have first hand experience but have heard that Paypal gets pretty draconian when people dispute charges that were funded via credit card. I didn't know that Visa would be willing to absorb the charge though; if that happens, it seems like Paypal might not care.

they don't tell the consumer that they are doing it. Usually, it has to be under $100 for them to do it, and the issuing bank has to be a big one.

From my experience, Pay Pal is worthless. They never answer your questions, they are a pain in the @$$ as far as wanting all this information from you and in the end...for what? They can't even help you in simple times like this.

saleenpwr88 - sorry to hear about it. Good luck with everything.
