can someone tell me the fine for a ticket using cell phone in ny.

i got pulled over and cited for using cell in ny, but the officer did not know the penalty for the ticket ! i actually think giving tickets for cell phone use without a headset is a good idea so im not protesting the merit of the ticket. just curious of the penalty.

OMG, the officer did NOT know??? LMAO too funny!!

From the New York Department of Motor Vehicles Website (http://www.nydmv.state.ny.us/dmvfaqs.htm#cell):

Cell Phone Law
What is the law on cell phone use while you operate a vehicle in NYS?

New York State has passed a law that does not allow you to use a hand-held mobile telephone while you drive. If you use a hand-held mobile telephone while you drive, except to call 911 or to contact medical, fire or police personnel about an emergency, you can receive a traffic ticket and pay a maximum fine of $100 and mandatory surcharges of $50.

This violation is not a probationary license violation, and the DMV does not assign any driver violation points.

For complete information on this traffic safety issue and a copy of the law, see Car Cell Phones at the Governor's Traffic Safety Committee web site.

thank you supersquirrel :)

yeah is that pathetic or what? the officer did not know. i even politely asked. so it seems i might pay 50-100. why cant they make up there mind. i called my attorney and he said he could get me off it but it means i have to take a day off work and appear at the court. which of course is not practical.

but im guilty as charged so lol!

its just a hassle that i have to send this ticket off to indicate im guitly than i guess i have to wait for a response to let me know how much and than send in the fee.

it would just make so much more sense if they indicated that on the ticket so i can take care of it at once.

Sorry to hear that you got the ticket. This is one law that seems so obviously ridiculous to me that it hurts.
Now that I have to wear a head set to use my cell phone while I'm driving, I have a free hand for taking notes with while I hold my coffee in my left hand, and steer with my knee.

right before i was about to cross the tapanzee bridge.

i was only going 65 on the far right lane. passed her after she just pulled over someone else. and within 30 secs pulled behind and flagged me over.

should be on the back of the ticket. There will be a section for speeding fines, moving violations other than speeding and a non-moving violation section. The cell phone summons is considered a non-moving violation. I cannot remember what the fine is.

look on the back of the summons under all others and then add the surcharge.....

I guess it was a trooper that got you, but I would expect the same basic ticket layout as Mike is used to.
On the back side of the ticket, it should list offenses and fines. There should also be a section for "all others" or "all other violations" That is where you should find the price for your violation. Don't forget to add the NYS surcharge, too.

I'm glad to say that I am not very familiar with the layout and design of your common traffic ticket.
Maybe you should call the courthouse and ask them?

I got stopped for not wearing a seat belt, $75 fine and a $50 surcharge!! I can deal with the fine but the surcharge !???

mike ny

actually i would rather have the money used for the officers dinners than the politicians lol

it just would be nice if they told me in advance how much im paying.
