This is why a good maintenance company is invaluable...

It just sucks.
 
People who run a shady business are not going to keep a pristine paper trail. And face it, receipts can be manufactured. The only way this would ever be challenged is if they were audited by the IRS or there was enough evidence for a warrant which, I can guarantee you, there will not be over a fish. LFS buy stuff from customers all the time, cheap, or for store credit. All they really have to do is mock up something in a computer, for customer X, who traded in their gem tang cause it was being a jerk so we gave them 5 years worth of free maintenance...oh well look at that. They fell off the face of the planet....oh gee the address was fake? Darn, sorry about that. Yes, receiving stolen goods is still theft and yes they could go to jail (and would) but the problem is proving it. Remember--innocent until proven guilty. The ease at which people steal pets and claim them as their own is exactly whey people microchip them so they have some sort of "vin number" and a person can have paper work claiming the animal is theirs. Other than that, all you have is a piece of paper from the pound, or registration papers, that could belong to any dog. With fish, while you might have a receipt, if you bought it from a business, you probably will not have one if you bought it from an individual (put an ad in livestock for sale for a gem tang for 500 bucks cash and see how fast it you get pms.)
The point is paperwork, taxes, all the things a legitimate business do are exactly what someone running a business under the table or with shady ethics will not do. It's highly unlikely, if the company is guilty, that this is their first time doing it. I guarantee you they have covered their *** if they have any common sense. Yes oxymoron for a thief, but you get the idea.

Which is why I said that initially I would have called them and told them that the nanny cam captured the whole thing and that they had an hour to return it in good health or the video goes to the cops.

If they returned it then maybe... maybe all could be forgotten. If they really did steal it, then this would have panicked them and maybe they would have returned it. If they didn't then they could call me on my BS and that would be that.

But that's water over the dam. I wouldn't have trusted them in the first place and if I had to use a company like that, you can bet your last dollar that there really would have been a hidden camera. If they stole a fish, what to say they didn't rifle through my house for other things?

Yes I think this is a fake story. If I had a tank with a 5000 fish I be damn sure to tell the company about my baby. Be damn sure to tell them if that fish gets a scratch to call me. But maybe that's just me.

Yeah I get the same feeling. I think they'd be better off stealing electronics from the house. How easy would it be to sell a gem tang that you just stole? :hmm5:

Wouldn't it be a little tough to tell the guy his stereo died so you threw it out.
 
As far as all of this paper work stuff goes, it depends on what the response from the cleaning company is if they dont have said paperwork. Just because he doesnt have paperwork, and his business doesnt do things the way theyre supposed to be done, while in the court of public opinion, given the circumstances its pretty safe the assume hes guilty. In a court of law, not having proof of purchase doesnt make him guilty of theft. You would need proof that they have YOUR fish.

Not saying you couldnt still take them to court and win, but its not a slam dunk like some folks are making it out to be

Okay guys I went to the lfs yesterday. Lfs owner said he time stamped the pictures and emailed them to the guy. He did not get any news after that. He said last time the original owner was considering to talk with a law firm to learn if a case can be filed or not.

I also asked him about "potential paperwork" for proving ownership. He said ideally there should be one, but the issue is there is no official requirement or format for that. He said most of the time many fish arrive in a single shipment. Not all stores or the suppliers list the individual fish species in such a shipment. So say a shipment of $12k worth of fish have arrived a year ago ,the guys can just say this fish was part of that shipment. Or if he had a gem tang in stock anytime in the past that died or even got sold, he can say that the fish is still not sold and the fish in question is that fish. There is no requirement for taking dead or sold fish out of the livestock list even if there is a livestock list to start with. So all in all, he said there is no such think like a "barcode" on a fish that you can use to identify an individual.

About the story being fake, if a guy I just met and the lfs owner did not try to troll me, the story is real.

Any further updates? I hope he got his Gem Tang back!

Maybe someone can come up with a safe way to microchip prized fishes?
 
I had a person from our cleaning crew in my old office steal my maroon gold stripe clown out of my work tank and walk out with it in a coffee cup...

Security "Nanny Cam" caught it all. fish didn't make it :(

Hope this guys story ends better. huge difference between cost obviously, but the principal matters
