Perhaps I'm misreading the picture, but it looks like your new overflow allows water to flow under it as well?

No, it is sealed with silicone where it meets the old overflow column. The water only flows over the weir. Here are some pictures of what it looked like before I installed it:

It is held in place by the return line on the left and a small clip glued to the right, as well as the silicone.
