Could someone please tell me if I am out of line

I don't think it's the shipper's responsibility to check the weather conditions. I think he should have notified you of the friday shipping, ask gotten your 'ok' prior to actual shipping, and it sounds like the packing job was shoddy as well. He should replace the frags (except the LE) and give you a partial refund, imo.


Btw, what does this have to do w/ our local forum? :confused:
 
I was just going to ask that too.

But I dont think that either buyer or seller is out of line. The seller should be responsible for checking thier owm weather. If the weather is going to be bad, then tell the seller to hold off on shipping. The seller is willing to ship out everything but the watermelon, which is fair.

If the seller was a vendor and not a hobbyist, then it would be thier responsibility to check weather and replace everything. But even some vendors have disclaimers stating that they are not responsible for weather.
 
It seems you already had an agreement as to when the corals should be shipped, which is extremely important. Recipients work their whole schedule around that arrangement, sometimes taking a day off work in preparation.

I think the fact that he disregarded that agreement and packaged the frags poorly, you should be entitled to a considerable refund.

Jedinija- Thank you for your input. The fact that the seller offered to replace SOME of the micros does not seem like a fair deal to me. The watermelon was almost half of the total price. While I agree that a partial replacement is a good step, it is still unfair. If I sold you a green slimer and a superman for $100 and the superman didn't make it. Would you feel that was a fair deal? In addition, please re-read the seller remarks...he does not feel he has to replace anything.

Does it matter if he is or isn't a BAR member? Joe is sharing an experience with us which could help a people with their "member" transactions.

FWIW, this is exactly what this board is about, learning and sharing.

I don't understand why someone would send stuff out on Thursday or Friday at this time of the year.

I sold some macroalgae to a guy in Sac. He wanted me to ship it out on wed/thursday for friday deliver. I told him that it would be better to wait until Monday.

Hopefully you get some $$ back Joe :) ..

There are two sides to look at everything.

As a buyer, I can understand why you're mad. You paid for something but didn't get what you want you'd be ****ed.

As a seller, you sold something and shipped it out and a third party screw up which put you into this mess you'd be on fire as well.

You both took a hit.

If the seller contacted you prior to shipping and ask if it's ok to ship on Thursday for Friday delivery and you "OK" it. Then I don't think there's anyone to blame but yourself and of course mother nature.

If you never OK the shipment for Friday delivery but the seller just shipped it out anyways, and tell you it was shipped go wait at your doorstep the next day, then the seller's at fault.

I think it's only fair if he replace what he can for you now and about the Water Melon being his last and only frag and you must have that frag, perhaps you can do an IOU for them when they do grow out you're first in line for them, or refund you for just that one frag. He's got nothing to loose since the frags he have in his tank will continue to grow out.

What ever it is, good luck. I've seen worste seller than this and boy do I wish i can put my hands around their throats and squeeze every last bit of air out of their lungs.
 
I really dont see what the problem is with the shipper. If he has a legit account with FedEx, when filling out the paperwork for the shipment you place a value on the shipment. If you label it perishable through FedEx and it arrives late you get a total refund not only for the amount of shipping but also what you said the value was of the shipment. I have sent out hundreds of orders and FedEx usually fouls up one out of ten. I simply call FedEx tell them that the shipment was lost due to there mistake and they credit me for everything! This guy is ripping you off, if he was legit and had a shread of grey matter this would never be an issue. Like I said if FedEx was truely at fault here, then you walk away without losing any money.

This is also a good reason why not to buy animals from "Garage" dealers. Just my opinion on the last comment.

dannieboiz - nice math formula! Thank you for your input. I wish to add a little to it though. Both parties have not taken " a hit". I have, but the seller has not lost anything. As for the Friday shipment, I never OK'd the Friday shipment, I didn't know when he was going to ship. He delayed it several days, and answered one of my PMs with a tracking number. The seller has offered to replace a few micro heads, but that is all. I have not taken him up on it. While it may be foolish not to get SOMETHING out of the deal, I do not want to pay $200 per micro head simply because thats all he had left. I have asked for different corals... or simply splitting the debacle in half 50/50. He has so far not replied. I'm sorry you have had worse situations.

This brings up a point though. I NEVER order from fellow reefers. I am usually the schmo who buys the Atlantis $15 per polyp zoos instead of buying them from an RC member. This has confirmed for me that buying from a big name store has 2 advantages. First, no hassles such as described above; and second, their higher end corals are the real deal. I bought tubbs zoos from Atlantis, and know that they are tubbs zoos. I can't say that about a some guy from San Jose that I don't know. Sorry for the rambling.

BIAS :rolleyes: I've never bought live stock from ANY online seller and I don't think I'll ever will. I think this was just an innocent mistake that can be avoid. Not a good enough reason to scare off from buying from your fellow reefers.

I think the point here isn't to avoid purchasing from fellow reefers altogether, but to purchase from reputable sources. Whenever I make a purchase on livestock from out of town (which is very rarely), I make sure the seller has plenty of posts/feedback prior to doing so. Unfortunately, it's one of those lessons that's learned from trial and error (been burned on a couple high priced items before).

I also think it's worth avoiding buying from fellow reefers when they have to SHIP. In the Bay area, there are great LFS's and great individuals out there to buy from direct. They just aren't set up to worry about all the things you have to worry about in shipping unless they do a lot of it. Also, a big outfit has more to lose if they mess up your order in this way when you trash their name.

More importantly, I'm only really posing to see if my avatar shows up.

not to get off topic, this would be my last post in regard of this...

Based on the last few responses, I think we should just remove the entire " Selling, Trading and Transaction Feedback Forums " and keep everything between the Local Reef Clubs only. :eek2:
