Haha. U dint know the hbpd well. They would be there next day.

Now if u told them I was there in one of my cars they would send a few units immediately. True story
 
Unless your pix is out of sequence, it seems that he had already have something in his hand in the first pix. Could have been something like coins, candy, ect....
 
What can you do with a citizens arrest? Tie them up so they don't walk away?

If he paid with credit card, I am sure HBPD can get the info. from the seaside to track him down. May be Kevin should look into that? If not, we just do the Pulp Fiction thing.:D
 
Cop wannabe dude at work says u can make a citizens arrest. U just have to call it in and state ur making one till they arrive.... which could be awhile. Not a top priority especially since it wasn't a felony. He says u could call it in as a theft in progress and they would show up quickly but not sure how much (if any) trouble u could get in. He days more than likely u won't but the first officer could issue a ticket for misuse of 911

Best bet... Just tell Jim it interested in the clam and get his number and show up with the cops to pick it up

You can make a citizen's arrest, but you can't "detain" him. A citizen's arrest usually only works when the police are present to detain the suspect.

I'm not a cop, but I did stay at a Holiday Inn last night........... :D
 
we went to seaside today... in the parking lot we devised a plan...

it consist of me asking him if he took kevin's clam, then pulling him outside, ask him for his ID and if he doesn't reply, i'll just give him a little beat down... then let him go... if he pulls a "they started it" it will be our word against a thieves...

i think it will work... what do you thinks...?
 
For a misdemeanor, the private citizen must actually witness the crime, and must make the arrest immediately. A citizen cannot arrest for a misdemeanor committed a long time ago. Also, the misdemeanor must constitute a "œbreach of the peace."

I guess I watch too much Sienfeld...I got citizens arrest mixed with the good samaritian law.I think the good samaritan says if you see the guy who stole from a friend and the friend isn't poresent you can oficially kick his butt for the friend.(-_-)...or you can detain his fixie and give it to your friend as compinsation for his loss.lol..(even steven)...my son rides fixie...he wears manpri's..that's the mans version of capri shorts...I call the Nutcracker shorts..I helped him put the bike together from an old school 21 speed and it cost over $350 just in parts.
