so whats the excuse of buying the Oddysea lights then? their shapes are close to other fixtures? this is no diffrent, even if you change out the ballasts and bulbs your still buying a cheap fixture and supporting a chineese company.

People want to save a few bucks by buying cheap pumps. No matter how much it hurts their own self interest, there's really no stopping that sort of idiotic behavior.

Your Aquarium should not be risked to save a few bucks on cheap knockoffs.

And any high end piece of equipement doesnt compare to mother nature(the ocean)..so if you're that concern about the health of any livestock being at risk, why keep them in an aquarium and not in the ocean where the belong?..you know good and well that any fish(especially that blue hippo tang) kept in captivity wont live their full life span. .

Oh btw,im not against or with any brand product thats been discussed here...just my .02

If they labeled them Geisemann, I would have a problem with that too.

I don't care at all about people buying cheap things, I like to as well if it makes sense to. I have a major problem with companies trying to benefit on the backs and efforts of other companies by trying to label their products on someone else's brand label.
 
I don't see what the big deal is. If you like it then buy the pump and use it. If you do t like it then don't buy the pump and don't care about who is using it.
For those if you makei g the argument about jeabo coping another pump and relabeling it and possibly nuking your tank can you consider this. Major drug companies spend billions of dollars in R&D to get the FDA to approve a drug(ie aspirin) but alot of you guys choose to buy the generic because its cheaper. Why would you guys care more about your aquarium having a "generic" pump but you don't care about your body having a "generic" medicine?
 
And how many years they have to wait till they can make generic drugs?
Everyone has a right to their opinion.
I disagree With yours argument. One thing is to make it yours And another to copy somebody else work. And don't mention profits....
 
They have to wait years because the major drug company's have patents on them. Once the Patent expires all the small companies make the same drug and just remane it.
That means some of you guys should be buying the non-generic brand of meds so your not taking profits away from them.

A recent polling post in RC showed out of 136 respondents, 50% has bought or planning to buy a Jebao wavemaker, 33% for Vortech/Ecotech, and 28% for Tunze. The market share erosion is obvious.

Of course the poll would show that. You take the 300k members here and probably about 20% of the people have fairly large budgets for there systems. There are always going to be more people with less to spend on their tanks then people with more. The fastest selling items are never the most expensive.

What would you rather buy a civic or 3 series BMW? Given the 300k members in there current state which would be best for you? I'm sure a fairly large portion would buy the civic.... It's a great car and Gets you from point a to b.

I have looked at these fairy close and think they do move some serious water. I would buy one of them for a frag system. The only thing stopping me from getting one for the display is the cord in the tank...it's really bugs!

I work for a contract pharma company. We make alot of the name brands and generic for the companies that sell them. The other companies develop them and then often have another company actually make the drug once the FDA approves it. And the patent on a new drug lasts for seven years. Trust me that those companies make bank during that time. They are the only company that can sell it so they can charge what they want. They probably make up for any R&D costs within the first year. And the generic is exactly the same thing or else the FDA wouldn't approve the generic to be sold. And the company that makes the name brand usually also ends up making a generic after the 7 years is up. In those cases, we make the name brand and generic at the same time. They just end up getting two different stamps on the pill.

Yes, Tunze does have some patents on the pumps, but most would probably not hold up in a court of law if someone were to actually take them court. Theie cease and desist order deals with their 'design' patent on the pumps. Design patents are for decorative features only. If the features serve any type of use besides just looking pretty or nice then the patent is not enforcable. Tell me what on those pumps does not serve a purpose. The rounded shape...increases where the powerhead can be pointed so it serves a purpose and a design patent does not apply. The slits on the powerhead are for water flow another utility so again a design patent does not truly apply. A design patent would protect something like a decorative imprint (cute little flowers/fish/waves/etc) around the edges of the pump because such a design is a purely decorative feature that serves no other purpose besides looking pretty. Tunze filed a design patent not a utility patent. why? Because Tunze didn't really invent anything. They just tweaked already existing pumps. If they had invented something, they would have filed a utility patent. Obviously, they knew the patent wouldn't be approved because water pumps/powerheads already existed prior to their pumps. So they filed a design patent to attempt to keep other companies from also designing a rounded powerhead. The US customs office doesn't have time to spend hours reviewing every patent that comes through especially for such a niche market. They get lots of patent applications per day. They expect other companies to contest 'false' patents, but court costs a lot and takes time. So Tunze was hoping to hinder competition with their bogus patent. It's a common practice in business. Not exactly ethical but common. We saw something similar a few years back with the Orbitech LED patent. It was basically a bogus patent that hindered LED progress in the market for years. AI was the only company willing to pay to use an obviously bogus patent. Once the other companies got sick of it, they took Orbitech to court and had the patents overturned which is why controllable LEDs soon flooded the market. I remember people being up in arms over the obvious bogus LED patent especially since it hindered competition in the market. And many of these same people don't care that the bogus Tunze patents are doing much the same thing. They are falsely hindering competition so that they won't ever have to lower their prices. And yes, this does hurt the pump market. Other companies would surely start designing rounded powerheads that performed similar to the Tunze if a bogus patent was not in effect.

I collect mid-century mosern furniture and knock-offs are common but not illegal. Why? Because furniture serves a use. A chair is for sitting, a drawer for pulling and storing stuff inside. Only purely decorative details are protected. The one case that pops to mind where the original manufacturer won over the knock-off producer was about a dresser. The knock-off copied the entire design including the decorative etching on the drawers. The original manufacturer won the case because the knock-off company copied a design. It copied the etching which served no utility besides looking pretty. If it had not been for this detail, the knock-off company would have won. I as a consumer am expected to do my homework if I want to buy an original and not a knock-off. However, it is illegal for a knock-off to try to sell their piece as an original Knoll, etc. They cannot try to pass their piece off as made by the original manufacturer when it was not. I don't see Jeboa doing that with their pumps. They are not calling them Tunze.

And on a side note, Vortech does have several utility patents on their pumps. Why? Because they didn't just tweak existing designs. They came up with a revolutionary idea of placing the motor outside the tank. That was a genuis and new idea. Tunze's pumps while good aren't revolutionary. They are just modifications of already existing pumps.
