I do agree It will be impossible to get somebody to the court. In many countries Business disputes are handle different...... In China Red tape can be American business best friend.....:) It doesn't matter what you know -but who you know.....

Hello everyone,

We we have received a letter for a patent violation on the Jebao pumps and their design. Everyone at this time in the US has been ordered to cease and desist all sales and orders on the Jebao pumps including the import into the US.

I am not sure why anyone is arguing with anything as nothing has been produced by a poster who hasn't even provide a copy of the letter, recipient, etc.

i don't have any of the wavemakers listed but the jebao wp-40 isn't a knock off. it may look like the tunze but there not trying to sell it as a tunze. i don't believe in another company copying designs but if someone ever makes a copy of a mp10/40 for a 1/4 of the price you better believe it'll sell like hotcakes. i'm thinking there are already several companies with these copies just waiting for ecotechs patten to expire.
the reason the tunze patten won't hold up is because it's just like any other wavemaker that can be programmed. the only thing they may have put a patten on that would stick would be the ball type design that lets it rotate more than the others.

A knock off is something that looks very similar, but is not using company names or trademarks.

A counterfeit is what it would be if they were using the Tunze name.
 
So there has been a lot of 'back and forth' here in this thread and very little real info. So does anybody know, and is anybody 100% sure what the status is for the Jebao wp40 & 25 as it relates to the Tunze letter? I'm not looking for 'I think' or I assume' or even 'I heard'. I want to know:
1) Is the Tunze letter just a letter to their distributors asking/telling them to stop selling Jebao 40's & 25's?
2) Is the US government telling everybody to stop sell them in the US?
3) Is US Customs going to try and stop imports of 40's & 25's direct from Jebao into the US by distributors?
4) Is US Customs going to try and stop imports into the US by end users buying them from Hong Kong?

Number 1 seems reasonable and likely to be the real situation, Numbers 2 & 3 seems a bit harder to believe, but possible. Numbers 4 seems almost impossible to believe or enforce. I don't know the reality of the situation, and from all the BS in the other threads, I don't think many, if anybody else, knows either. So any ideas about who I can contact to find out the truth? I'm open to suggestions on that part.

I will not say who contacted my club about it, but i can assure you the letter is real. Will it do anything though, absolutely not, it's just a scare tactic to get us distributors of tunze products to stop selling the item or lose your distributor rights

2) is the us government telling everybody to stop sell them in the us?never in a million years will this happen, for a fact i know even if they wanted to stop it in court, tunze does not have a leg to stand on when it comes to international trade. This is just a letter to their distributors, no legal paperwork has been filed

3) is us customs going to try and stop imports of 40's & 25's direct from jebao into the us by distributors? again not possible, the amount of goods coming into this country it'd be virtually impossible to stop the goods from coming in

4) is us customs going to try and stop imports into the us by end users buying them from hong kong? not possible to enforce unless they put jebao and also fish street & every other distributor on the black list which involves all shipments from this vendor to be stopped & hand verified & scanned. There are lists liek this in the us, my company actually was put on it 5 years ago when a company with the same name in another country was put on it and it was a major pain in the butt to get taken off of it

Oh wow thats nuts.I picked up a wp40 yesterday ust to see what its like.I was against at first but for cost i thought would try.Local store sold like 10+ while there yesterday so others must think worth a shot also.

What he failed to tell you was that Tunze addressed it already, they increased voltage and widened the output.
