That's definitely not a whelk. Looks like a stomatella to me as well. Harmless grazers and you've probably got several more in the tank.

Just google images whelk and you'll get a pretty good idea. They look basically like a nassarius.

Cool! I have another but no picture that I thought was a stomatia but it has a greyish shell on its back yet looks like this one. Still the same?

Probably. They come in a wide variety of colors.

this was my whelk snail. they have tattooed type necks

Yup. Some of them have tattooed necks. Some non-threatening species also have tattooed necks, lol. However, the one in the pic, and half a dozen species that look very similar, make up the vast majority of the "bad" whelks that people find in their tanks. They have a fairly distinct outline, even without trying to ID by animal characteristics.
