OT: In need of a good lawer

Yeah it can be tough to be polite sometimes....
I've been called all sorts of names and had all sorts of evils wished upon me....What most people dont realize is that I carry a small voice activated digital recorder in my pocket that picks up the entire conversation perfectly.

Later in court, the "I'm innocent that officer is lying and he was rude to me" act gets blown right out of the water when you play the tape to the judge. I like seeing their facial expressions when they realize they're caught lying to the judge.
Perjury anyone????

Wouldn't that tape be inadmissable in court? If the defendant was unaware, secretly taped, etc? Not lawyer bashing here, but those guys can be pretty crafty....

Simular situtation with one of my co-workers, He drive one of the semi's for the company, One morning during 3am break he decided to run up to Wal-Mart and grab a few things while they were loading his truck. Turned out to be a bit busier at Wal-Mart than he thought, and he had to hurry back. One of the city cops popped him doing 34. It turns out to be a school zone. Normal speed limit is 35mph, There is a sign there that states 25mph during school hours. We are still confussed about this one. How are you going over the speed limit if you are doing 34 in a 35, at 3:30am. School is not in. He lost his case in court, Judge said a school zone is a school zone. They are trying to take his CDL away for speeding in a school zone. He wasn't even driving his semi. I guess the state is in need of some cash.

Ok Nick,

I have even noticed the flashing signs that say 25 MPH school zone WHEN FLASHING... or something to that effect. Could a lawyer have got him out f it by pointing this out?

Wouldn't a minor out at this time be a different issue all together?

That what we all thought too. That is why we are confussed. How can it be a school zone at 3:30 in the morning. If any kid is out a 3:30 in the morning he is breaking curfew.

W/o an attorney you can't win. It's set up that way to protect the profession. Remember the judge is an attorney also.

I believe the law in Missouri is that as long as one of the people is aware that the conversation is being taped it's OK.

Same goes for phone conversations.

That's what I understand the law to be in MO. Our neighbor is a family attorney and my second oldest boy is a stepson who's dad is absent so he had us tape record conversations with his sperm donor to confirm things.

Missouri is a one party state regarding knowledge of taped conversations. So only one person needs to know that the conversation is being taped. So yes, those tapes are admissable in court.

Regarding the school zone thing,
It really depends on the signage declaring it to be a school zone. If it declares it to be a school zone w/ no time constraints, (IE from 7 am - 4 pm) then its a school zone 24-7. Personally, I think thats kinda stupid, and would have hoped the judge would have figured that part out. I know our judge is pretty fair on things, and has thrown out some tickets I felt were justified by other officers. Our judge probably would have thrown that one out...

Now the school zone when flashing signs...those are a whole different ball of wax...


Wish I could be of more help, but I've noticed a distinct lack of common sense in a lot of police departments and local governments.....
