Power company killed off my tank!

Hoping for some help here...

A few months back (it was around April'ish) a representitive from my local power company contacted me and let me know that I am eligible for a H.E.A.P. payment (Heating Electricity Assistance Program). All I have to do she says is go down to the Public Assistance building in my town and apply (I had been laid off so I was eligible). She said that if all of the funds from '07 did not get used up, then this year the state would cut back on the funding available. Fine I said, why not take a free heat and electric payment? Then she told me that she would send me out a 'disconnect notice' due to the fact that the Public Assistance office MUST have a disconnect notice to start the ball rolling with a HEAP payment.

My first reaction to her was "ARE YOU SURE I'M NOT GOING TO GET SHUT OFF ON ACCIDENT"? She says 'No, not at all. The notice is just for the HEAP office, no one will come out and turn your power off".

Sure enough the power company came and cut my power off at about 8am shortly thereafter. I called this same woman back (she is the consumer advocate for this LARGE power company) and she had been out of the office for a few days her voicemail said and it would take her 'a few days' to sift through and call back all of her messages. So I called her cell phone. (I've had a lot of problems with this company, so she personally gave me her cell number. I've been 'screwed' by this company a few times before and this is why she personally contacted me about the HEAP payment and why she gave me her cell phone number. I now deal DIRECTLY with her and the PSC or Public Service Commision - that's how bad things have gotten. I'm even involved in a civil suit against them) Her phone wasn't even turned on. I called for hours and hours. Left messages and messages and messages...got no call back and didn't know what to do. I called the companys 800 number and they had no knowledge of my dealing with this woman (of course) and said that I wouldn't get turned back on until the NEXT DAY at the earliest. That means the tank would be without power for over 24 hours. Now I live in a house, so it's not like I could run an extention to the guy upstairs, downstairs or the like.

After standing there moving water with a plastic pasta type spoon and watching my fish die, I called back the 800 number and told them I smelled gas. ;) Someone was here within 30 mins and they turned me back on. (this was LATE that night thoguh...)

LOOOOONG story short, she OFFERED a free payment on my past due balance. Told me I needed a disconnect notice, and sent me a FALSE one. Told me I would NOT be disconnected and not to worry.

Well I WAS disconnected and lost most of my fish and LOTS of corals. The temp got down in the low 60's and I had no airation or water movement for about 15 hours.

I lost my:

Orange Shoulder Tang
Chocolate Tang
Desjardini Sailfin Tang
Yellow Tang
Black Tang
2 Helfrichi Firefish
Copperband Butterfly
6 Line Wrasse

10 Fire shrimp
5 Cleaner shrimp
5 Brittle stars

Crocea Clam
Maxima Clam

And TONS of my SPS corals/frags. The SPS was hit the hardest, is there a reason for this?

Anyway where I need help is this...I have filed a claim with the company stating that the woman filed a FALSE disconnect notice to get me a HEAP payment that I didn't even know about...then I was ACTUALLY cut off and lost most of my livestock. Not my fault I argue.

They want a list of my losses with prices to REPLACE. I'm NOT a big coral name person, so all I have is SPS skeletons...no clue what most of them were called. My fault on that I guess. I've bought frag packages from a few folks here, spent over $1000 at Fosters and Smith, got a BIG frag pack from Your Reef.com, TONS of $$ at local stores, etc etc etc.

AS AN EXAMPLE: Now if I bought a coral for $50 a year ago, and it grew to a piece that I'D ESTIMATE to be worth $200 is that what I tell them it would cost to replace? Or do I replace the $50 piece that I originally purchased? I feel they should pay me for the size that I LOST, not the size that I bought it as. I hope this makes sense.

ANOTHER EXAMPLE: Let's say I bought a fish that cost me $100 2 years ago as a juvenile but has now grown to an adult. How in the world to I go about figuring out the fish prices? PLUS all of my fish were in my care FOREVER, so I know they were healthy etc. You all know what I mean...if they 'replace' my fish who knows what I'll get. What if they replace my Firefish with Firefish that croak in a week? I HAD FISH THAT WERE BULLETPROOF AND THEY KILLED THEM!

Another thing is attachment. They are not JUST FISH as eveyone I know says. They are my pets...my charges entrusted to MY care... My Chocolate Mimic Tang for example was my favorite fish and I got him as a GIFT from someone who has since passed on. How do I put a price on that fish? Is he worth more due to 'sentimental reasons'?

I still have some of the fish in my freezer, pics of most as well...and still have ALL of the coral skeletons. I'm not out to 'stick it to them' but I really want to get what I feel I deserve.

What do you all think?

P.S. The company is called NATIONAL GRID. They are the WORST company in the entire universe. Hands down. They are worse than Glass Cages. :strooper:

Also before you respond telling me that I need a gas operated generator, it's already on the list of things to get.

And I guess it wasn't all a COMPLETE loss. It enabled me to tear the tank down, get a new stand and 'start over'. Sad that it wasn't MY choice to start over but... I don't know what I'd do if something like that happened again.
 
they won't pay for any of your fish just like they wouldn't pay for any food spoilage.

Problem is, you made an agreement with them that at any time they needed, they could essentially cut your power.

I trust myself to modulate my energy consumption far more than my local power cartel, uh, i mean provider ;)

Id quote a price you perceive it to be worth at the time of its demise. It took you alot of $ worth salt and electric and ect...ect...ect... to grow that coral to that size. Sorry to hear about your losses, gl with the new project.
 
you could afford a reef tank which is an expensive hobby in of itself, yet you wanted to get assistance for your bills, im sorry but i dont feel sorry for you or your situation, there are families just trying to keep warm and who need it and you want free electricity foryour fish, boohoo
 
I am sorry for the loss of your fish and corals, however I must agree with Kybreos - your greed got you into this mess and now you want sympathy?

kybreos many people (even people who make a lot of money) get layed off. If we could all see into the future just like you feel you can maybe we would all be as smart as your comment. Do you want the guy to sell all his belongings because he didn't have income for a few months.

Anyway, sometimes when things seem to good to be true they are. Especially when being thrown a sales pitch. I feel bad that you lost what you worked hard for but I'm sure the power company has a clause in their contacts against losses caused by power failure or the power being turned off.

Hope your employed again!?

I'm sorry this happened to you. Man it really sucks. I'd give them a price you perceive to be fair. I doubt your going to get full value for your livestock but hopefully you at least get a good start. Unfortunately they just aren't going to pay you $200 for a coral that was $50 when you got it. (I don't think) I also don't believe they will pay you any extra for sentimental value (nor do I think they should) I hope you get enough to at least get the same number of corals and fish you had and you can through good husbandry rebuild your tank. Again I'm sorry for your loss.
 
I feel very sorry for you. Awful situation. I would proceed with any suit you can, ask for the max. Got nothing to loose at this point.

OP I mean no offense but I don' think they owe you anything. It is your job to protect your assets and to pay for services. I am one of those people that think we are owed nothing from corporate America or our government. The minute your money ran out with them they have the right to cut you off. Sounds harsh but I am a little tired of the entitlement mentality in this country.

I hope the job thing works out... based on you restocking the tank I am guessing it already did.

I wasn't set to be shut off for non payment or anything like that...I DID however get backed up over the winter months by having my job outsourced to India.

Due to having a balance (and a payment arrangement set up) they contacted me with a 'free payment' from HEAP. As I stated earlier, if all of thier allocated funds were not used up from '07 then their funding would get CUT in '08.

Those of you who feel I was greedy or had a hand out or whatever must have missed that part. It was no type of situation where I was standing in a poverty line taking assistance away from some single mother of 11 who had no heat.

That said, if they felt I was eligible (and I was) then why not take the payment? I had not found other work at this point...and I took it. Not the point of the post.

Also, what does me having a nice reef tank in my living room have anything to do with my job being sent overseas? (why pay me $20+ an hour if you can pay someone in India $1 an hour) Just because I have had a hobby for a few years, how does that in anyway reflect on my current or future situations?

Yes I have gotten back into the swing of things (HELLO NEW EQUIPMENT) :) but that doesn't change the fact that I was hurtin over the winter.

At any rate, the woman I deal with exclusively has owned up to her company's error...and has stated for the record that she DID tell me I was not to be shut off, and that the disconnect notice was not official.

As far as the sentimental value of some of my animals, I know deep down you can't charge for that...that is my point. There is NO dollar amount you can put on them. My Chocolate Tang for example...yeah I can go buy one for $30 as a juvi or $60 as an adult or whatever, but it won't come from the person that gave it to me originally. It was irreplaceable.

Didn't mean to ruffle any feathers with this post...but boy did I ever in the beginning huh? Definitely didn't see it having THAT effect on folks.

I hope those of you that feel that way never have to leave your mansions and sell off your Porches and go through tough times like I did with 2 children and a woman I was trying to feed. Nothing makes me feel smaller than not being able to provide for my family. And as a matter of fact, I DID sell off quite a bit of reef related things...and my vehicle, and my guitars...the list goes on and on. In the face of adversity, you do what you have to do. That doesn't mean that big bad companies with monopolies can just take away the things that you DO have with one simple flip of the switch and then act like they could care less.

"Oh well just a fish tank'. Nah, it's way more than that to me. It was something I worked on and saved for, had my kids help me with and something I took much pride in for years.

Reminds me of all these cracked tank threads I see on here. Makes me sick to think of that happening to me. I can feel your pain...but there is a difference. That was an act of god...not the act of a heartless company.
 
hey semper i feel for you i had lost my position and was set up on a payment plan after i got a 10day shut off notice well month 2 came around and i missed the payment by 1 day. what made me mad was i called the day before to tell them i would pay them the day after i was suppose to well the "new girl" didnt do what she is paid to do(like anyone really does) and i lost my entire tank i was awarded nothing after that and just decided that im going to go solar and tell/help every one i know to get solar being that would be the only way i would know how to kind of "get them back" i wish you the best of luck and hope things get better for you and your family.
 
I'm sorry, but I would've sold off my reef tank and at the very least downgraded to something smaller before mooching off the government to pay for my electric bills. You were taking that risk when you opted into that program, and are now blaming others.

My electric company turns off power if you haven't paid after 10 days, sounds like you got a helluva better deal from your company in that they floated you for a couple of months without payment. Sometimes other things in life take precedence over keeping a big reef tank healthy, and I hope this experience has taught you that...
 
Semper Fi i am sorry for your loss but i can think of a few ways this could have been avoided.

you had 15 hours to buy a generator or a car power inverter that could have saved by my estimates over 2 thousand dollars worth of livestock :( if you really wanted to save them why not do something? i dont want you to take this the hard way because if i were you i would be hurting.

I am sorry but, it seems like it was avoidable.
