A environmental group is petitioning for eight species of damselfish, including Amphiprion percula (yes, clowns are damsels), as either Threatened or Endangered under the Endangered Species Act, as they have the potential to be endangered by global warming. If adopted, all interstate trade of these fish, either wild or captive raised, would become illegal, with penaties up to $50,000 per violation, and up to one year in prison. There is no provision under the ESA that allows trade of captive raised listed animals. The listing of any animal due to the threat of global warming would be a precedent. They're asking for these eight species, as they represent approximately 43% (by units) of the animals traded in the industry, according to their reference.
