Someone is using my photo to sell on eBay

Wow that is terriable.
You can "Report item" to Ebay staff.
Under "Counterfeits and copyright violations" I tell the staff what is going on. You don't want EBAY mad at you if you are a seller.

I contacted both the seller and eBay. It is sort of flattering that someone likes my photo enough to use it, but as a hobby photographer with a legal background, it is wrong on all sorts of levels.

Absolutely, get it taken down. You have rights a photographer. Don't lay down and throw them out the window. This person is MAKING MONEY off of YOUR image. Without that image do you think anyone would hit the buy button? I don't. Since your image is what is making people purchase the coral, don't you think you should be compensated for each sale via paypal? I do.

Agreed, and not only that.. the person is not selling the "actual" item pictured. Fraud?

I just think it's funny when you look at that auction in the context of the other coral auctions the seller has. This one is very obviously lit by sunlight compared to the all actinic look of the others.

She's been stealing a lot of photos lately. I've seen threads on this seller on at least three different forums.

I like how most of her zoas are "very rare, super rare, crazy rare, RARE RARE RARE" or derivatives thereof. (yours being RARE RARE RARE)

I had that happen to me one time. They didn't even copy the image before they posted it, they just posted a link from my site. I made a copy of the image on my site and changed the name of the copy and used that one for my pic. I then substituted another pic for the one that was linked. It certainly was not what the seller was expecting! That put an end to that.

I guess it's flattering that they liked it enough to steal, but it's not even that good of a pic.

It's still up. You've posted better pics of that very same coral, IIRC.

Nice crisp picture. I can see why someone wants to use it.

Funny you mention that. When I first pulled up the auction page, I saw the pic and thought, "nah, that's not mine, it looks like complete crap." Then I noticed the base it was on as well as the leather in the foreground and those looked awful familiar. I had to go to my website and dig through the inventory system before I found that image. Yes, of the pictures to steal, that was not a good one.

Don't be flattered--PLEASE TURN THIS GIRL IN TO EBAY!!! This is your property & she is making $$$ from it. It is in the Ebay selling rules that you may not use a picture that isn't yours without the photographer's permission. She has been warned over & over & it is your responsibility to turn her in. You owe it to yourself & all the other photographers she is stealing from!

I'm not sure what it actually takes for Ebay to ban someone. She's already been told to remove at least 5 pics, thru complaints to them. Then a week later she uses them again.
