Tank disaster

Regardless of the outcome of this good or bad. The result is bad for cadlights. I too own a cadlights tank and I would not consider them if I was buying again.
 
Tank disaster

One of my friends was gonna build a 500g custom tank with cadlights, but after seeing this post I warned him and ended up getting his tank somewhere else.
 
I showed my cousin this thread a few days ago. He's in the process of upgrading to a 300 gal tank and was considering Cadlights. Needless to say, he is looking for another builder. Sucks cause Cadlights is local and was convenient for local pickup. He's not taking any chances with a 300gal in his living room and 2 toddlers in the house.
 
If a product, like this tank, fails and does no damage to any other property the claim is limited to the terms of any warranty. This is called the "economic loss" rule. If a product fails and damage other property, as in this case, the manufacturer is strictly liable and any limitations in the warranty are meaningless in most cases.
 
I can't think of a single tank manufacturer that will cover damages due to a tank failure, and that's written on the warranty for every tank I've installed from all glass and marineland to glasscages and ATM, etc. They will all replace the tank, but will not assume any other liability. So really, this applies pretty much industry wide.

What a disaster. I'd imagine the loss of coral and fish he had for 10+ years outweighs the loss of equipment and damage to the home. That kind of time and energy put into maintaining a system this large can never be replaced.

Quick question, OP said the AI lighting system was destroyed as well. Can this occur just from the power supply being soaked? I can't see how the actual LED units being hung above the tank would get destroyed from blow out as the water goes outward and downward not upward.

Right, until you take them to court and the court sides in your favor...
 
Wow out of all threads I've seen on tank failures, this is a first for me. The whole pane blowing off like that...dang. I can't imagine how devastating that would be. Hope things get worked out. I know we all take a risk when we put a tank in the house, but I think we all expect the tank to be built well enough to hold up. If anything that level of failure could be viewed as very negligent in the manufacturing.

Yes but when they build a tank that is not properly assembled why should Ivan have to eat the cost for damages?

There is no way the court makes the manufacturer pay for damages. No way! Homeowners insurance pays for damage to the house. Cadlights offered to replace the tank. Anything living in that tank is the sole responsibility of the owner, end of story.

It is tragic and terrible that it happened, but tank failures can and do happen when there are tens of thousands of them out there in operation. Just because you are emotionally attached to something doesn't mean that a company is all of a sudden legally responsible for paying thousands and thousands of dollars for no reason.
 
He doesn't eat the cost of damages. The homeowners insurance eats the cost for damages. The tank company offers a new tank, which I believe they did.

I bet he's going to eat the cost of no future business from the reefing community. I believe that's going to weight more than the cost of resolving this matter.

In the grand scheme, this is not going to effect their business. It is a small dedicated few who browse these forums. Tanks fail. It's the nature of the beast. They did what they said they would and offered a new one. OP is being unreasonable in expecting what basically amounts to emotional compensation because of his attachment to his fish/corals and what he had created.

Yeah and this is above and beyond their limited warranty. Someone could have been seriously injured with that glass pane popping clear off the tank. Jury's find fault for less.

Even 10 people not ordering custom tanks from them will effect their business. Likely cheaper to pay a settlement.
