Jebao Cross Flow Pump

I have yet to see a formal lawsuit announcement other than the one in the one article which was heavily biased to Maxspect about them protecting their IP. Quote contained no reference to a lawsuit though nor any links or comments about patents and such they would have to use as defense.

I would love to read more on it though if you have links.

Can't wait! Once any US distributor has them I'm sure they'll be available on Amazon and eBay. Still curious about patent info for the maxspect product (or any maxspect product) too!
 
Interesting though they are utility patents and are pending so they would need to get them first and would need to defend them as unique should it be raised that they are not so.
 

You can't issue a cease and desist on a pending patent. The pending patent allows you to seek for damages starting on the date the patent became pending and that's about it but Maxspect first has to get the patent. Then they would have to prove the patent infringes on no prior art if Jebao contests it. The letter in the link is nothing but a scare tactic at this point.

Considering how long the patent process takes Jebao is probably going to be on revision 2 or 3 of the thing by the time Maxspect gets their patent. That's a lot of jebao gyres sold most likely.

I for one will probably not be using a gyre in my new tank (Jebao, Maxspect or otherwise). My Gyre is a complete PITA to clean, never goes back together the same way twice, to many fiddly parts, meh.

If Jebao does copy the design, then they should be sued! I expect better engineering from them. Like removing the need for half the parts and making it far, far easier to disassemble/reassemble in the correct fashion.

The patent was filed 04/22/2014. So you're saying that Maxspect should either go back in time to file the patent or should not bother trying to defend it? :confused:

They have filed a request for a patent but do not have one as of yet. They may never receive one. And when they do they would have to defend it against the fact that the tech already existed so it all depends on how they worded it and what their proposed patent covers.

Have yet to see any patent documents. Cross flow technology is older than United States. The only thing maxspects has registered is their company name.

You guys don't think Jebao has teams of attorneys investigate before investing millions?

I agree with the above poster that this this blog post is primarily a scare tactic and that Maxpect, IF the patent is granted (I don't believe this device is new or novel), will have a long hard road to defending it. That is if they can find a defendant in the first place.

I did not know that, all I heard was folks screaming "the chinese have copied maxspect gyre".
So one chinese company copied another chinese company, and our fellow reefers are suddenly concerned about patent rights of chinese companies?

You clearly did not read all of the posts in this thread (and several others you have posted in regarding Jebao products).
 
Good luck SkullV. In order to argue or position rationally, one must be doing so against the rational. I'm still waiting on proof from previous accusations that were incredibly inflammatory and obviously unfounded.

That would be a good idea if technology did not change dramatically and very rapidly. Plus some of those guys spend family life savings on their tanks. To copy tanks of the month is like trying to copy olympic athletes when you only plan on losing some extra pounds.
