Jebao Cross Flow Pump

They claim their mounting was copied, to me it was tunze they copied but i havent really looked at hydor pumps.

HYDOR USA Inc. (HYDOR), of Sacramento, California, a wholly-owned subsidiary of HYDOR Srl of Vicenza, Italy, the innovator and manufacturer of the Koralia and other lines of aquarium products, announced today that it has filed a complaint with the U.S. International Trade Commission against Jebao Co., Ltd. (Jebao) of Zhongshan City, Guangdong province, China. The ITC complaint requests both (1) that the RW line of Propeller Pumps and the WP line of Wave Maker products be excluded from importation into the United States, and (2) the distribution and sale of any such domestic inventories be stopped. The complaint asserts that these Jebao products infringe U.S. Patent No. 8,191,846, a patent protecting HYDOR’s aquarium fitting technology. HYDOR considers its aquarium fitting technology and its related patents to be very valuable, and it will remain resolute and active in vigorously enforcing its patents in this area.
 
Patent is simply the fact that they use a suction cup + magnet as a mount. This is an easy fix for Jebao pumps they simply remove the suction cup part from all their pumps, and continuing selling. Hydor is hardly going to "bury" them.

Personally I'd rather have stronger magnets than suction cups as most all rubberized products will disintegrate over time in an aquarium.

Then that would basically be copying tunze. And im sure if hydor win this, others will start fileing complaints.

I've read of Tunze sending Cease & Desist type letters about 5 years ago, apparently nothing ever came of it.

But looking over Tunze's patent for a magnetic mount it, it actually sounds like Hydor's mount. They can't possibly have a patent for holding stuff to flat vertical surfaces which refrigerator magnets have been doing for years.

The holder has a second part which carries a second part of the magnetic-force apparatus and can be applied to a second side of the pane wherein the holder has a plurality of elastically deformable holding cups on it side that faces towards the pane.

In the case of the holder according to the invention, two contributions to the holding force are obtained: on the one hand, the magnetic contributions and, on the other, the contributions of small holding cups, which work like suction cups. Said suction cups have sharp edges which work their way even through contaminants located on the pane, and thus come directly into contact with the surface of the latter.

Granted the only Tunze pumps I have are some old 6100 which used 3rd party magnets to hold it on, and a newer stream pump, but i don't recall it having suction cups.
 
No they do not have suction cups. But if jebao removes the suction cup part to get past hydor then it would resemble the tunzes mount rather than hydor. However tunze haa the sound dampining rubber peices inbetween the magnet and the clip that holds the clip.
 
Im just sure if one company and get jebao to either have change their pumps to get past the patient or have them stop selling them, others will also follow. It just needs one company to get through first though.

Hydor is fighting a losing battle. Same goes for Tunze or anyone else. No US distributor supports Jebao. There's a reason why major distributors like Marine Depot, Central Pet, Phillips Pet, etc. don't carry their products even though they are very popular and likely profitable, they risk the relationship with other companies like Tunze, Ecotech and Hydor; plus legal enforcement of patent law subjecting themselves to punitive damages and forfeiture of any profits made from the sale of Jebao patent infringed products. Think about where you bought your Jebao pumps from. China, EBay or the one distributor in the US, Fish Street. Which is clearly run by Chinese immigrants and who knows how or where they are conducting business. The only way to stop it is at US customs. And you can bet they have more important things to look for other than aquarium pumps. As they say... It is what it is.

Vote for Trump, he says he's going to show China who's boss. :lolspin:
 
I bought my Jebao pumps from Reefbreeders. I'm not sure, but they sure seem American. If not, they at least have a fluent English speaker on staff. haha

Good point, but I think you get mine. They did start carrying them not too long ago... And perhaps they'll get a cease and desist letter on Monday as a result of this thread. ;) Or maybe that's Hydors goal is to win their case, knowing that they can't stop Jebao from making them, but they can go after U.S. distributors and retailers.

The reason is low mark-up. Those websites are multimillion dollar companies not interested in $47 Jebao RW-4 delivered by Amazon; free 2 hour shipping!

They're not websites, they are major US pet distributors to brick and mortar LFS who can push a hell of a lot more product and have a ton of purchasing power. I'm not going to derail this thread even further, but I will say you're wrong about the mark up. You'd be shocked at how little profit is made by retailers on most of the popular products we own.

I wouldn't be shocked; I know aquarium business is bad business.

What is a bit shocking and ridiculous is that a PC that can help your kid get a college degree is $499, a little pump that moves water around in a tank is $599? There is nothing within that device to justify the price, except for high markup by multiple middle-men.
 
I see no problem with it. The price is dictated by how many people are willing to buy at a particular price point. I assume you're referring to Ecotech and clearly they don't have any problem capturing market share. Fortunately there are alternatives. Which leads me to my next point and backs my previous point in my last post. Jebao is capturing large amounts of market share. Probably surpassing some of the popular companies we're familiar with. That's market share none of the distributors and retailers are benefiting from. Why? Because they have too much to lose if these manufacturers go after the distributors. And, I'll add I'm pretty sure ReefBreeders doesn't have a legal team advising him on this issue, unlike the big corporations.

RB is licensed to import and sell.
Cheap chinese off Amazon is the future of this hobby. That's all there is to it. I bet the high-price guys have a hand full of super rich CEO's sitting around cursing jebao right now. Their emotionally attached fans are pointlessly screaming foul on a few forums. Couple years from now, Jebao and a dozen similar reasonably priced producers will own the market.
